CAN-SPAM as written cannot possibly stop spam. The flaw is in the term Opt-Out. The only possible way to stop spam is to make it illegal to send messages or hire the sending of messages of a commercial nature to anyone who has not requested such messages from that sender. In other words only Opt-In can be permissable. The only valid advertising on the Internet should be located on websites and as part of newsletters or other email that the recipient requested.
