  • Friday, December 19, is the effective date of the National Guard and Reservists Debt Relief Act of 2008. The Act, Pub.L. 110-438, provides a temporary exclusion from the bankruptcy means test for Reservists and members of the National Guard called to active duty or homeland defense activity after September 11, 2001, for at least 90 days (the Act amends 11 U.S.C. § 707(b)(2)(D)). The Judicial Conference of the United States has approved an amendment to Official Form 22A which includes a new Part 1C where qualifying debtors can invoke the temporary exclusion from the means test. The amended form will be effective on December 19, 2008, the same time as the statute

    In addition, the Judicial Conference has approved transmitting proposed Interim Rule 1007-I to the courts for adoption as a local rule to implement the Act.

  • New staff. We at the Bankruptcy Court are very excited to announce that we have a new case administrator in our Bangor office. Kristen Capilli started with us on Monday, Nov. 3. Kristen is a 2007 graduate of Johnson & Wales University in Providence, R.I., and most recently worked as a paralegal at Cetrulo & Capone LLP in Boston. If you're in the neighborhood please feel free to stop in and say hi to Kristen. She'll be the one you don't recognize.

  • As the result of an unexpectedly long-running hearing in Portland on August 20, the courtroom podium demonstration was cancelled. Anyone who would like information or a demonstration on the use of the podium in Portland should feel free to call Glen Cole of the bankruptcy court's automation staff, at 780-3482 x.231. And a reminder that there will be a demonstration of the Bangor podium after the morning hearings on August 28, likely sometime around noon.

  • The October 16th hearing date is CANCELLED. Any matters already set for October 16th will be rescheduled to the October 30th Bangor hearing date.

  • There will be demonstrations on the use of the courtroom podiums
    immediately after the hearings on August 20 in Portland, and on August 28
    in Bangor. The demos will be followed by Q&A sessions and hand-on use with
    court automation staff, and are open to anyone in the Bankruptcy Court
    community who wishes to attend.

  • Effective September 10, 2008, Judge Haines's regularly scheduled Wednesday hearing times in Portland will change: Chapter 13 matters will be heard beginning at 9:00 a.m.; Chapter 7 matters will be heard beginning at 11:00 a.m.; and Chapter 11 matters will be heard beginning at 11:30 a.m. For all matters scheduled for hearing on or after September 10, 2008, please use the new times. This change will not affect parties' ability to self-schedule in appropriate circumstances.
