Guidance: Re-imported Burmese and Non-Burmese Articles Covered by the Burma JADE Act of 2008

This provides guidance pertaining to one exception to the provisions of the Burmese JADE Act of 2008. Burmese covered and non-Burmese covered articles that were previously exported from the U.S. (including those that accompanied an individual outside the U.S. for personal use) are allowed to be re-imported into the U.S. by the same person without having been advanced in value or improved in condition by any process or other means while outside the U.S. More information about the Burmese JADE Act of 2008 can be found at the Public Law No: 110-286 - Tom Lantos Block Burmese JADE (Junta’s Anti-Democratic Efforts) Act of 2008 page. Parties who are temporarily exporting Burmese and non-Burmese covered articles from the U.S. are advised to register those articles prior to export through either of the methods listed below.

  • Register the articles on a CBP Form 4455 - Certificate of Registration or a CBP Form 4457 - Certificate of Registration for Personal Effects Taken Abroad.
  • Use a carnet issued by the U.S. Council for International Business. This is more suitable for commercial samples and items for trade shows and exhibitions.

If either of the above-mentioned documents is not presented at the time of re-importation into the U.S., the importer must present documentary evidence that supports claim that subject articles were exported and re-imported by the same person without having been advanced in value or improved in condition by any process or other means while outside the U.S. Without such documentation, the articles are subject to seizure by CBP.

This information should be distributed to all Port Directors, Assistant Port Directors (Trade), CBP Officers, Import Specialists, Entry Specialists, Fines, Penalties and Forfeiture Officers, importers, brokers, and other interested parties.
