"Delaware: Final Authorization of State Hazardous Waste Management Program Revision" July 12, 2000 (65 FR 42871) EPA determined that the State of Delaware's application for final authorization of revisions to its hazardous waste program satisfies all of the requirements necessary for final authorization. Unless EPA receives adverse comments as specified in the companion document (65 FR 42959; July 12, 2000), final authorization of the RCRA rules will be effective September 11, 2000. "Texas: Final Authorization of State Hazardous Waste Management Program Revisions" July 13, 2000 (65 FR 43246) EPA determined that the State of Texas's application for final authorization of revisions to its hazardous waste program satisfies all of the requirements necessary for final authorization. Oil Program "Oil Pollution Prevention and Response; Non-Transportation- Related Facilities" July 14, 2000 (65 FR 43840) Corrections to the final rule published on June 30, 2000 (65 FR 40776). PROPOSED RULES RCRA "Land Disposal Restrictions; Treatment Standards for Spent Potliners From Primary Aluminum Reduction (K088) and Regulatory Classification of K088 Vitrification Units" July 12, 2000 (65 FR 42937) EPA proposed to revise certain treatment standards for spent potliners from primary aluminum reduction (EPA hazardous waste K088) under the LDR program. If promulgated, nonwastewaster forms of K088 waste would have to meet a new treatment standard, measured by a version of the Toxicity Characteristic Leaching Procedure (TCLP) that uses deionized water as the leaching fluid. EPA also proposed to revise the treatment standards for total and amenable cyanide in K088 nonwastewaters. In addition, EPA proposed to classify K088 vitrification units as RCRA Subpart X miscellaneous treatment units. As a final matter, this proposal discusses the appropriateness of extending the rationale and regulatory status applied in this proposed rule for K088 vitrification units to all vitrification units treating RCRA hazardous waste. "Delaware: Final Authorization of State Hazardous Waste Management Program Revisions" July 12, 2000 (65 FR 42959) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the State of Delaware. EPA authorized the State's program revisions as an immediate final rule without prior proposal in the final rules section (65 FR 42871; July 12, 2000). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by August 11, 2000, the immediate final rule will become effective September 11, 2000. "Hazardous Waste Management Program: Final Authorization of State Hazardous Waste Management Program Revisions for State of Texas" July 13, 2000 (65 FR 43284) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the State of Texas. EPA authorized the State's program revisions as an immediate final rule without prior proposal in the final rules section (65 FR 46606; July 31, 2000). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by August 30, 2000, the immediate final rule will become effective September 29, 2000. CERCLA "National Oil and Hazardous Substances Pollution Contingency Plan National Priorities List" July 5, 2000 (65 FR 41392) Proposal to delete the Lakin/Poplar Oil Company Superfund Site. "National Priorities List for Uncontrolled Hazardous Waste Sites, Proposed Rule" July 27, 2000 (65 FR 46131) List of the seven sites proposed to the National Priorities List. NOTICES RCRA "Agency Information Collection Activities: Submission for OMB Review; Comment Request; Land Disposal Restrictions No- Migration Variances" July 14, 2000 (65 FR 44046) EPA announced its plan to submit the following continuing Information Collection Requests (ICR) to the Office of Management and Budget (OMB) for review and approval Land Disposal Restrictions No-Migration Variances. "Focus Group Meeting on Draft Reference Guide for Public Participation in Permitting Programs" July 17, 2000 (65 FR 44050) EPA is drafting a reference guide of the requirements and recommended best practices in public participation for use by states authorized to implement the air, water, and waste permitting programs. The purpose of this focus group meeting is to exchange information on the development and content of the guide and to seek feedback with the expected outcomes of refining the guide and the methods for distributing it. Comments and questions from the general public will also be discussed at this meeting. "Hazardous Waste Identification Rule (HWIR): Identification and Listing of Hazardous of Hazardous Wastes; Notice of Data Availability and Request for Comments" July 18, 2000 (65 FR 44491) EPA is making available for public comment human health and ecological risk data and information relating to an exemption from hazardous waste management that we discussed in a Federal Register notice published on November 19, 1999 (64 FR 63382). That exemption, also known as the Hazardous Waste Identification Rule (HWIR) exemption, would exempt listed hazardous wastes that meet chemical-specific exemption levels from hazardous waste management requirements. Today's notice again extends the comment period for the November 19, 1999 HWIR exemption discussion until October 16, 2000. "No-Migration Variance From Land Disposal Restrictions for Exxon Mobil Corporation, Billings, MT South Land Treatment Unit" July 20, 2000 (65 FR 45052) EPA is reissuing a no-migration variance for land disposal of hazardous waste to Exxon Mobil Refining & Supply Company Billings Refinery, a division of Exxon Mobil Corporation, formerly known as Exxon Company U.S.A. Exxon submitted a request to EPA on March 24, 1998 for renewal of the no-migration variance in conjunction with their State of Montana hazardous waste permit reissuance. Exxon also petitioned to amend the variance by adding the newly listed hazardous waste, Petroleum Refinery Primary Oil/Water/Solids Separation Sludge (EPA hazardous waste code F037) generated at the Exxon Refinery in Billings, Montana. "Land Disposal Restrictions: Notice of Intent To Grant a Site-Specific Treatment Variance to Safety-Kleen (Deer Park), Inc." July 26, 2000 (65 FR 45978) EPA announced it intents to grant a site-specific treatment variance from land disposal restrictions (LDR) treatment standards for approximately 2850 cubic yards of hazardous waste that Safety-Kleen (Deer Park), Inc. currently stores at its Deer Park, Texas, facility. Safety- Kleen requests this one-time variance because the waste cannot be treated to the interim K088 total arsenic standard of 26.1 mg/kg. Furthermore, a portion of the waste cannot meet the 28 mg/kg total dithiocarbamates treatment standard for the waste codes K161, P196, and P205. If this one-time petition is granted, Safety-Kleen may dispose of this waste in its on-site RCRA Subtitle C landfill provided the waste complies with the specified alternative treatment standards described in this notice and all other applicable LDR treatment standards. This one-time variance is effective on August 25, 2000. "Regulatory Reinvention (XL) Pilot Projects; Notice" July 28, 2000 (65 FR 46456) EPA is requesting comments on a proposed Project XL Final Project Agreement (FPA) for Buncombe County.
