Charles R. Wilson, United States Attorney for the Middle District of Florida, announced today the filing of two civil actions pursuant to Title 47, United States Code, Section 510, seeking forfeiture of radio equipment used to operate two unlicensed radio stations in Tampa.
Esther Nieves allegedly operated an unlicensed radio station from her residence. Reverend Alberto Acosta allegedly operated another unlicensed radio station from Iglesia Pentecostal Luz Radiante (Pentecostal Church of Shining Light). As part of these forfeiture actions, agents of the United States Marshals Service and the Federal Communications Commission seized property alleged to have been used in the broadcasts by Ms. Nieves and Reverend Acosta, pursuant to warrants of arrest in rem issued by a United States Magistrate Judge.
The cases are being investigated by officials of the Federal Communications Commission. These forfeiture actions will be prosecuted by Assistant United States Attorney Patricia A. Willing of the Civil Division.
A civil complaint is a formal document alleging the basis on which assets are claimed to be subject to forfeiture.
