NEWS Report No. CS 95-15 CABLE SERVICES ACTION September 15, 1995 COMMISSION ACCEPTS FOR COMMENT A PROPOSED RESOLUTION OF CABLE RATE COMPLAINTS INVOLVING COX COMMUNICATIONS, INC. The Commission has accepted for comment a proposed resolution of cable rate complaints involving Cox Communications, Inc., including Cox's recently acquired Times Mirror Cable Television, Inc. systems ("Cox"), that will, if finally adopted by the Commission, resolve over 400 pending cable television rate complaints filed since September of 1993 against Cox, provide $7.1 million plus interest in refunds for one million Cox subscribers and result in the removal of additional outlet charges from all Cox systems, regulated and unregulated. Comments from complainants on the proposed resolution are due by October 17, 1995 and reply comments are due by November 1, 1995. Key elements of the proposed resolution include:  $7.1 million plus interest in subscriber refunds in the form of credits on subscribers bills.  Cox agrees to eliminate all charges for additional outlets in regulated and unregulated franchise areas. This will affect 171 franchise service areas.  Cox may move a maximum of any four regulated services to a single migrated product tier in each of its franchise areas in which it did not offer an a la carte package.  A finding that Cox's cable programming service tier rates as of June 30, 1995 are not unreasonable.  This action does not constitute an admission by Cox of any violation, or failure to conform to, any law, rule, or policy. -more- -2- Commenting on the proposed resolution of the Cox rate complaints, Cable Services Bureau Chief Meredith J. Jones said, "This is a solid proposal. The removal of additional outlet charges, over seven million dollars in direct refunds, as well as agreement as to allowable rates going forward are great benefits to Cox's subscribers."
