How is it implemented? The Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal promotes environmentally prudent management of waste imports and exports and sets broad criteria for the shipment of certain wastes between parties to the Convention. The Basel Convention binds individual governments to the conditions set forth in the Convention when they sign it and then ratify its terms under their national procedures. After ratifying the Basel Convention, governments may establish domestic regulations, consistent with the terms of the Convention, for importing and exporting covered wastes. Is the United States a party to the Basel Convention? The United States is not currently a party to the Basel Convention. Although the United States signed the agreement on March 22, 1990, it has not yet ratified the Convention. Therefore, the Basel Convention does not apply in the United States (64 FR 44722; August 17, 1999). Does the Basel Convention restrict shipments between parties and non-parties? Ordinarily, the Convention prohibits shipments of hazardous waste streams between Basel parties and non-parties. However, the Basel Convention allows parties and non-parties to enter into separate bilateral or multilateral agreements governing hazardous waste movements. The transboundry movement of hazardous waste between parties and non-parties can occur if these bilateral or multilateral agreements meet the requirements of Article II of the Basel Convention. Has the United States entered into bilateral and multilateral agreements to allow transfrontier shipments of hazardous waste with Basel parties? The United States currently has entered into bilateral agreements with Canada, Mexico, Malaysia, and Costa Rica. A multilateral agreement that allows transfer of hazardous waste between members of the Organization for Economic Cooperation and Development (OECD) for recovery purposes exists between the United States and the members of the OECD. Does the Basel Convention place restrictions on importers and exporters in the United States? The Basel Convention does not place any restrictions directly on U.S. importers and exporters, as it is binding only to governments that have ratified the Convention. When importing or exporting, or participating in transfrontier movements of hazardous waste, U.S. importers and exporters must follow the applicable requirements of 40 CFR Part 262, Subparts E, F, and H. However, members of the regulated community within the United States should be aware of those countries that have ratified the Basel Convention and that adhere to its terms. Parties to the Basel Convention with which the U.S. has not established a separate bilateral agreement may prohibit movement of hazardous waste to and from the United States (Article 4, paragraph 5). What is the Basel Ban? The Basel Ban, adopted in 1994 by certain countries, bars shipments of hazardous waste from developed countries to less- developed countries. The Basel Ban does not apply to U.S. importers and exporters, as the United States has adopted neither the Basel Convention nor the Basel Ban. CERCLA 2. Impact of New Soil Treatment Standards on Remedy Decisions On May 26, 1998, EPA promulgated the second part for the RCRA Land Disposal Restrictions (LDR) Phase IV rulemaking (63 FR 28556). This rulemaking, among other things, promulgated alternative LDR treatment standards specific to soils contaminated with RCRA hazardous wastes. Prior to this rulemaking, contaminated were subject to the same treatment standards as hazardous waste. The soil-specific standards were designed to alleviate some of the difficulties that arise when trying to treat hazardous contaminants in soil matrix. Numerous Superfund sites may have based their remedy decisions on the older treatment standards and incorporated these standards as applicable or relevant and appropriate requirements (ARARs) in the site's Record of Decision (ROD). How do these new soil- specific treatment standards affect remedy decisions already in place at Superfund sites? Once a ROD is signed and a remedy is chosen, EPA generally does not reopen the decision unless a newly promulgated or modified requirement calls into question the protectiveness of the selected remedy (40 CFR 300.430(f)(1)(ii)(B)(1)). In general, the requirements that are determined to be ARARs for a site "freeze" at the time of ROD signature. EPA believes that it is necessary to "freeze" ARARs in this manner (at the signing of the ROD) to ensure the finality of the remedy selection and expeditious cleanup of contaminated sites. New requirements promulgated after the signature of the ROD need to be attained (or waived) only when EPA determines that these requirements are ARARs and that they must be met in order for the remedy to be protective (55 FR 8666, 8758, March 8, 1990). If it is determined that the new requirement(s) must be met in order for the remedy to be protective, the ROD must be modified to reflect the change in the remedy requirements. The determination of a remedy's protectiveness dictates whether a ROD must be reopened. Overall, the new LDR treatment levels for contaminated soil are less stringent than the existing treatment standards (63 FR 28556, 28635; May 26, 1998). Therefore, LDR treatment standards in existance before the alternative soil standards are generally no less protective than the soil-specific treatment standards. However, nothing prohibits a potentially responsible party (PRP) from requesting the lead agency to open a ROD to incorporate new or modified requirements. In this case, it may benefit a PRP to request the opening of a ROD to incorporate the new soil treatment standards as ARARs. New Publications How to order... FINAL RULES RCRA "Rhode Island: Determination of Adequacy for the State's Municipal Solid Waste Permit Program" February 14, 2000 (65 FR 7294) EPA authorized Rhode Island's municipal solid waste (MSWLF) permit program. EPA determined that Rhode Island's MSWLF permit program is adequate to ensure compliance with federal MSWLF requirements. The final authorization will become effective on February 14, 2000. "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Final Exclusion" February 23, 2000 (65 FR 8874) EPA granted a petition submitted by Chaparral Steel Midlothian, L.P. (Chaparral Steel) to exclude from hazardous waste control a leachate from Landfill No. 3 containing K061 electric arc furnace dust and minor amounts of K061 wastewater. The final authorization will become effective on February 23, 2000. "Louisiana: Final Authorization of State Hazardous Waste Management Program Revisions" February 28, 2000 (65 FR 10411) EPA determined that the Louisiana Department of Environmental Quality's application for final authorization of revisions to its hazardous waste program satisfies all of the requirements necessary for final authorization. Unless EPA receives adverse comments as specified in the companion document (65 FR 10440; February 28, 2000), final authorization of the RCRA rules will be effective April 28, 2000. "Missouri: Final Authorization of State Hazardous Waste Management Program Revision" February 28, 2000 (65 FR 10405) EPA determined that the Missouri Department of Environmental Quality's application for final authorization of revisions to its hazardous waste program satisfies all of the requirements necessary for final authorization. Unless EPA receives adverse comments as specified in the companion document (65 FR 10440; February 28, 2000), final authorization of the RCRA rules will be effective April 28, 2000. CERCLA "National Priorities List for Uncontrolled Hazardous Waste Sites" February 4, 2000 (65 FR 5435) This rule adds 10 new sites to the General Superfund Section of the NPL. "Natural Resource Damage Assessments- Type A Procedures" February 8, 2000 (65 FR 6012) On May 7, 1996, the Department of Interior (DOI) published a final rule establishing two simplified, or "type A," procedures for assessing natural resource damages under the Comprehensive Environmental Response, Compensation, and Liability Act. Those procedures incorporated two computer models. DOI made a number of technical corrections to the models on November 10, 1997. This rule makes additional technical corrections to those models. PROPOSED RULES RCRA "Deferral of Phase IV Standards for PCB's as an Underlying Hazardous Constituent in Soil" February 16, 2000 (65 FR 7809) EPA proposed to temporarily defer a portion of the May 26, 1998, Land Disposal Restrictions (LDR) Phase IV rule. Specifically, EPA proposed to temporarily defer the requirement that polychlorinated biphenyls (PCBs) be considered an underlying hazardous constituents (UHCs) when they are present in soils that exhibit the toxicity characteristic for metals. Comments must be submitted by April 3, 2000. "Hazardous Waste Management Program: Final Authorization of State Hazardous Waste Management Program Revisions for State of Louisiana" February 28, 2000 (65 FR 10440) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the Louisiana Department of Environmental Quality. EPA authorized the state's program revisions as an immediate final rule without prior proposal in the final rules section (65 FR 10411; February 28, 2000). The immediate final rule provides a detailed rationale for authorization. Unless adverse comments are received by March 29, 2000, the immediate final rule will become effective April 28, 2000. "Missouri: Final Authorization of State Hazardous Waste Management Program Revisions" February 28, 2000 (65 FR 10440) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the Missouri Department of Environmental Quality. NOTICES RCRA "Recovered Materials Advisory Notice III" February 7, 2000 (65 FR 5933) EPA published several corrections to the January 19, 2000, Recovered Materials Advisory Notice III. "Notice of Availability: Announcing the availability of a new draft guidance document entitled Screening Level Ecological Risk Assessment Protocol for Hazardous Waste Combustion Facilities" February 11, 2000 (65 FR 7012) EPA provided notice that the following draft guidance document Screening Level Ecological Risk Assessment Protocol for Hazardous Waste Combustion Facilities (Peer Review Draft) is available and ready for review. The comment period has been extended from February 22, 2000 to March 10, 2000. "National Priorities List; Agriculture Street Landfill Superfund Site" February 7, 2000 (65 FR 5844) Notice of Intent for Partial Deletion of Moton Elementary School, including Mugrauer Playground (Operable Unit 4) and Groundwater (Operable Unit 5) of the Agriculture Street Landfill Superfund Site from the NPL and request for comment. "Notice of Extension of Time to Submit Comments on Consent Decrees Lodged Pursuant to Sections 104 and 107 of CERCLA" February 7, 2000 (65 FR 5891) On December 1, 1999, the United States lodged a proposed consent decree with the United States District Court for the Southern District of Texas in United States of America v. GAF Corp., et al., pursuant to 104 and 107 of CERCLA. Notice is hereby given that the period during which the Department of Justice will receive comments relating to the proposed consent decree has been extended through the 30th day following publication of this Notice. "Superfund Probabilistic Risk Assessment to Characterize Uncertainty and Variability" February 15, 2000 (65 FR 7550) EPA has developed and is requesting public comment on a draft guidance entitled Risk Assessment Guidance for Superfund Volume 3 Part A; Process for Conducting Probabilistic Risk Assessment (RAGS 3A). Comments may be submitted until April 21, 2000. Comments received after that date will be considered to the extent feasible; however, EPA will not delay finalizing the guidance in order to accommodate late comments. "Environmental Protection Agency and International City/County Management Association Superfund Relocation Policy Meeting" February 17, 2000 (65 FR 8141) This document advises the public that the EPA and the International City/County Management Association will hold a public meeting to discuss comments received on the Interim Policy on the Use of Permanent Relocations as Part of Superfund Remedial Actions.
