Abstract In the Transport Law it states that the authorization of new taxis can be refused if the interests of public transport are adversely affected by this, i.e. if the local taxi business is threatened by this. The criteria for judging the ability to function were put into practice for the taxi business in the case of West Berlin. A survey of this describes the original position in the taxi business and is concerned with the development of a basic concept to find the ability of occasional taxi traffic to function based on the legal requirements. Data on this concern the different interests of the authorities and of the taxi business when permitting new authorizations, the work concept and methodical procedure. Explanations of characteristics for the ability of a taxi business to function, like economy, supply and demand, density of taxis, distribution of taxis is the area served, waiting times at stopping places, potential demand, judgment parameters (evaluation) of ability to function follow.
