U.N. legal opinion of 9 January 1992 advises that there should be no legal obstacle to the U.N. General Assembly giving authorization to the new organization envisaged in the draft convention, on the prohibition of the development, production, stockpiling and use of all chemical weapons and on their destruction, to request advisory opinions of the International Court of Justice (ICJ), as long as the terms of the convention which govern the relationship between the new organization and the U.N., as well as the terms of the relationship agreement to be negotiated between the two organizations, follow the principles and relevant provisions governing the relationship between the U.N. and the International Atomic Energy Agency (IAEA). The IAEA experience provides the model of how the envisaged organization may propose regulating its relationship with the U.N. However, it would be for the U.N. General Assembly to decide whether or not to approve such a proposed relationship agreement and whether or not to authorize the new organization to request advisory opinions of the ICJ.
