ANSWER:

The penalty of perjury language is only required on an unsworn declaration, not on a declaration that is sworn to before a notary public. Case managers should refer to the format contained in Rule 1005-2. If you are unsure about the language used, please forward to chambers for their review. Do not automatically strike an affidavit (before getting chambers direction) unless it clearly is not in compliance with the new rule.

Bottom line: if it's a notarized declaration, no need for separate penalty of perjury language

if it's NOT notarized, it needs the language.
