IS-0049 Dated: September 15, 1994 PAS-2 (PANAMSAT AT 43ø West Longitude) THE COMMISSION, by its Common Carrier Bureau, took the following action pursuant to delegated authority under Section 0.291 of the Commission's Rules. The International Facilities Division (IFD) processes applications for international earth stations which utilize the separate system satellite PAS-1 at 45ø West Longitude (W.L.) for the provision of fixed-Satellite Service (FSS) between the United States and those countries listed in Attachment 3. These services must be and have been consulted under Article XIV(d) of the INTELSAT Agreement and approved by the FCC. PanAmSat is scheduled to launch a new satellite called PAS-2 located at 43ø W.L. in November 1994. The new satellite has been consulted under Article XIV(d) and the Commission hereby approves its use for services in the FSS between the United States and the United Kingdom. The Commission has allowed for international earth stations to communicate and provide service through additional satellites within the same satellite system and in the same ocean region (such as INTELSAT Atlantic Ocean Region or Morelos) without further authority provided that the technical parameters and services of the earth station and the satellites do not change for that system. As an administrative convenience to Licensees and the Commission, we notify existing FCC Licensees that after the successful launch and positioning, the PAS-2 satellite may be utilized with no further authority from the Commission for services in the FSS if 1) the FCC Licensee is already authorized for these services via the PAS-1 satellite, 2) the frequency band, licensed powers, power densities, emissions, satellite arc, elevation angles, antenna azimuths and polarizations of the licensed earth station do not increase in order to communicate with the PAS-2 satellite, and 3) the services are in accordance with Attachment 3 of the IFD's Actions Taken Public Notice (copy attached). All other Licensees or new applicants must file FCC Forms 493 and 159 with the Commission to operate with this new satellite for services in the FSS between the United States and the United Kingdom. Other countries will be added to Attachment 3 as they receive Article 14(d) approval and are authorized by the Commission.
