ABSTRACT

The CEOS Reader Software Package contains the following software:

- CEOS_READER which reads SIR-C data from tape, copies data to disk, reads headers and outputs ASCII header files to disk.

- DCOMP contains subroutines for decompression and recompression of SIR-C data. For any format SIR-C data or AIRSAR format data, DCOMP will synthesize any polarization from quad pol data or a given polarization from dual and single pol data to a byte image. DCOMP also multilooks data to the desired amount.

- CVERT software which converts data between different AIRSAR and SIR-C data formats. CVERT also multilooks data to the desired amount.

- SIRC-REG software displays and co-registers SIR-C, XSAR, AIRSAR, and byte image data with and IDL graphical interface.

- RAVEN software runs with an IDL graphical interface and synthesizes any polarization from quad pol data, and calculates polarization signatures, performs statistical analysis. RAVEN works with both SIR-C and AIRSAR format data.

The SIRC Utilities Software, which is part of the CEOS Reader Software Package, is written in IDL and includes the following programs:

- SIRC_Synth: Image synthesis from decompressed SIR-C data. Allows the user to synthesize trial byte images using subsampled data. When the user approves the look of the trial image, an image is synthesized from the original data.

- SIRC_GetImgInf: Prints out the number of samples, number of records, data format and mode given the SIRC ascii header.

- SIRC_Extract: Draw polygons on a SIR-C image. Compute stats on values inside the polygons.

- ViewByte: Display a byte image. Scales the image to fit on the screen if necessary.

- ViewRGB: Displays a 3 color overlay given three byte images. Scales the image to fit the screen if necessary.

JPL DEMONSTRATION LICENSE AGREEMENT

Contract No.-None

This is a license agreement and not an agreement for sale. This license agreement (Agreement) is between your company, whose name and address appears below, (hereinafter called "Licensee") and the Jet Propulsion Laboratory of the California Institute of Technology (hereinafter called "JPL") and gives Licensee certain limited rights to use the proprietary CEOS Tape Reader Software. All rights not specifically granted in this Agreement are reserved to JPL.

Reservation of Ownership and Grant of License: JPL retains exclusive ownership of any copy of the Software licensed under this Agreement and, hereby, grants to Licensee a personal, non-exclusive, non-transferable license to use the Software pursuant to the terms and conditions of this Agreement. From the date of receipt, Licensee agrees to use reasonable effort to protect the Software from unauthorized use, reproduction, distribution, or publication. Licensee acknowledges that the Software provided under this Agreement are proprietary information to JPL, and as such Licensee agrees to receive all such materials in confidence and use the Software only in accordance with the terms of this Agreement.

Copyright: The Software is owned by JPL and is protected by United States copyright laws and applicable international treaties and/or conventions.

Scientific Collaboration: The program is provided to facilitate scientific or other technical collaboration in support of JPL/NASA projects. If licensee discovers any problem with the program or suggests or makes any improvement to the program, licensee shall inform the JPL technical contact of the problem or improvement in writing. Please report "bugs," discrepancies in the documentation, and suggested modifications and "work arounds" to the JPL technical contact. Your comments are extremely important to us and will be seriously considered in the development of this software. Please also report results of your studies in which you use this software package.

Definitions: As used herein, the following words, phrases, or terms in this Agreement shall have the following meanings:

" CEOS Tape Reader Software" means << see attached abstract >>.

"Software" means the actual copy of all or any portion of the programs delivered on the media, inclusive of backups, updates, or merged copies permitted hereunder or subsequently supplied by JPL.

"Related Materials" means all of the printed materials, user documentation, training documentation and confidential software activation code supplied by JPL under this Agreement.

Permitted Uses:

As each configuration of central processing units and/or networked systems may be unique, Licensee agrees to conform Licensee's use of the Software to the [insert serial numbers of computers that will host the software OR the name of the department that will use the software OR the name of the building that the software will be located in]. Licensee may install the Software onto the licensed computer systems only.

Licensee may alter, modify and merge the licensed Software program into other program material provided that the revised program can only be utilized on the designated processing unit and under the same terms of this Agreement, for Licensee's own internal use and not with a view to remarket or distribution thereof.

Licensee may make and maintain backup copies provided Licensee keeps possession of each backup. In addition, Licensee may make that number of copies of the Software necessary for its licensed site provided that all information appearing in or on the original labels, including the copyright and trademark notices are copied onto the labels of the copies.

Uses Not Permitted:

Licensee may not sell, rent, lease, sublicense, lend, time-share or transfer, in whole or in part, or provide unlicensed Third Parties access, to prior or present versions of the Software and Related Materials, any updates, or Licensee's rights under this Agreement.

Licensee may not make additional copies of the Software or Related Materials for sale or distribution outside of its business or university departmental organization.

Licensee may not remove or obscure any copyright or trademark notices.

The Software and Related Materials shall not become subject to application for patent or copyright by Licensee.

Assignment: Licensee shall not assign this Agreement or Licensee's rights hereunder without the prior written consent of JPL. Any purported assignment without such consent shall be null and void.

Term: The term of the license granted by this Agreement is in perpetiuity. This Agreement will automatically terminate without notice if Licensee fail to comply with any provision of this Agreement. Licensee will then return to JPL the Software, Related Materials and any whole or partial copies, codes, modifications, and merged portions in any form. The parties hereby agree that all provisions which operate to protect the rights of JPL shall remain in force should breach occur and Licensee agree that the obligation of confidentiality described in this Agreement is binding in perpetuity and, as such, survives the term of the Agreement.

No Warranty:

DISCLAIMER

THE SOFTWARE AND RELATED MATERIALS ARE PROVIDED "AS-IS" WITHOUT WARRANTY OF ANY KIND INCLUDING ANY WARRANTIES OF PERFORMANCE OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. USER BEARS ALL RISK RELATING TO QUALITY AND PERFORMANCE OF THE SOFTWARE.

Exclusive Remedy and Limitation of Liability: JPL shall not be liable for indirect, special, incidental, or consequential damages related to Licensee's use of the Software and Related Materials, even if JPL is advised of the possibility of such damage.

Indemnity: JPL, at its own expense, will defend and indemnify Licensee from all claims that the unaltered Software and Related Materials furnished under this Agreement infringes a U.S. Copyright, provided that Licensee give JPL prompt written notice of such claims and permit JPL the sole right to control the defense of such claims and provide JPL all reasonable cooperation.

As to any Software and Related Materials which is or in the opinion of JPL may become subject to a claim of infringement, JPL, at its option, will obtain the right for Licensee to continue using the Software and Related Materials or replace or modify the Software and Related Materials so as to make it noninfringing. If none of the alternatives is available on commercially reasonable terms then Licensee agrees to return the Software and Related Materials upon JPL's written request.

JPL will not indemnify or defend Licensee from any infringement claim resulting from Licensee's modification or alteration of any Software and Related Materials.

This section states JPL's entire obligation to Licensee and Licensee's sole and exclusive remedy for copyright infringement.

Export Regulation: Licensee agrees not to disclose or re-export any Software or Related Materials received under this Agreement, unless Licensee has obtained prior written authorization from JPL and the U.S. Office of Export Control.

Severability: If any provision(s) of this Agreement shall be held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

No Implied Waivers: No failure or delay by JPL in enforcing any right or remedy under this Agreement shall be construed as a waiver of any future or other exercise of such right or remedy by JPL.

Order of Precedence: Any conflict between the terms of this license and any Purchase Order or other terms shall be resolved in favor of the terms of this license.

Governing Law: This Agreement, entered into in the County of Los Angeles, shall be construed and enforced in accordance with and be governed by the laws of the State of California without reference to conflict of laws principles. The parties hereby consent to the personal jurisdiction of the courts of this county and waive their rights to venue outside of Los Angeles County, California.

Entire Agreement and Amendments: This Agreement constitutes the sole and entire agreement of the parties as to the matter set forth herein and supersede any previous agreements, understandings, and arrangements between the parties relating hereto.
