Mercury Treatment Standards under the Land Disposal Restrictions Program The land disposal restrictions (LDR) regulations in 40 CFR Section 268.40 contain waste-specific treatment standards that dictate the use of a particular technology or the reduction of hazardous constituents in the waste to a specified concentration level. The treatment standards for certain waste codes are divided into multiple subcategories. For example, the treatment standards for mercury (D009) are divided into high- and low-mercury subcategories based on the mercury content of the waste. At the point of generation, a D009 waste meets the high- mercury subcategory for LDR purposes. However, in treating the waste for another hazardous constituent, the generator reduces the mercury content and the waste now meets the low- mercury subcategory. Can the generator apply the low- mercury treatment standard to meet LDR? In this case, the treatment standard for the high-mercury subcategory that applied at the point of generation must be met at the point of disposal, regardless of the reduction of mercury content in the waste during treatment for another hazardous constituent. The generator of a waste must determine at the point of generation all applicable waste codes and treatment standards subcategories. These determinations apply throughout the life of the waste. All applicable waste codes must be determined at the point of generation so as to prevent the generator from diluting the waste to circumvent an applicable treatment standard (51 FR 40572, 40260; November 7, 1986). 2. Identification of Underlying Hazardous Constituents The land disposal restrictions found in 40 CFR Section 268.40(e) require characteristic wastes to meet the universal treatment standards (UTS) in Section 286.48 for all underlying hazardous constituents (UHCs) before the waste is land disposed. The definition of UHC includes all constituents listed in Section 268.48, except fluoride, selenium, sulfides, vanadium, and zinc, which are reasonably expected to be present at the point of waste generation (Section 268.2(i)). Why are fluoride, vanadium, and zinc specifically excluded from this definition? Fluoride, vanadium, and zinc are excluded from the definition of UHC because these constituents are not found in Part 261, Appendix VIII. Hazardous constituents are specifically defined as those listed in Appendix VIII of Part 261 (Section 268.2(b)). Appendix VIII lists "chemical constituents which have been shown in scientific studies to have toxic, carcinogenic, mutagenic, or teratogenic effects on humans or other life forms" and is used by EPA to determine if a waste contains hazardous constituents and should be listed in Sections 261.31, 261.32 and 261.33 (45 FR 74889; November 12, 1980 and 52 FR 25942; July 9, 1987). Section 3004(m) of RCRA gives EPA the authority to develop treatment standards to diminish the toxicity of the waste or reduce the likelihood of migration of hazardous constituents. Therefore, EPA is not limited to regulating only those hazardous constituents for which a waste is listed and may develop treatment standards for additional constituents to protect human health and the environment (54 FR 26603; June 23, 1989 and 61 FR 15585; April 8, 1996). Because of this, zinc, vanadium, and fluoride appear in the UTS table in Section 268.48. However, since they do not appear in Appendix VIII, these constituents are not included in the definition of UHC. 3. LDR Treatment Options for Spent Incinerator Refractory Brick In order to properly clean and decontaminate a RCRA permitted hazardous waste incinerator at closure, a facility must dismantle the incinerator's inner liner, which is typically composed of refractory brick. Refractory brick that has come into contact with listed hazardous waste during the incinerator's lifetime carries a hazardous waste listing via the contained-in policy. A facility would like to dispose of listed hazardous refractory brick in a landfill. How should the facility comply with the land disposal restrictions (LDR) in Part 268 for the spent refractory brick? The facility may employ one of four options in handling the refractory brick in order to comply with Part 268. First, the facility can treat the brick to the numerical treatment levels in Section 268.40 for the listed waste contaminating the brick. The facility can, instead, treat the brick as hazardous debris (if the brick meets the definition of debris in Section 268.2(g)), and employ the alternative LDR debris standards in Section 268.45. Another option is for the owner or operator to ask EPA or the approved state agency to issue a determination that the brick no longer contains a listed hazardous waste and is thus exempt from all Subtitle C requirements (Section 261.3(f)(2)). Under this option, the debris need not meet an LDR treatment standard before land disposal (Section 268.45(a)). Finally, the facility can obtain either an equivalent treatment method variance according to Section 268.42(b), or a variance from the available treatment standards according to Section 268.44 for the brick. In general, the facility closure plan will detail closure requirements for the incinerator and may specify one of the four treatment options described above for the refractory brick (Section 264.112(b)(4)). Technical Assistance Grant Program; Final Rule October 2, 2000 (65 FR 58656) EPA published a final rule for the Technical Assistance Grant (TAG) program under CERCLA. The Agency has developed a final rule designed to further streamline the TAG program by simplifying application and management procedures, and allowing advance payments of up to $5,000 to new recipients. The intent of this final rule is to make grants for technical assistance more readily available to local community groups and to promote effective public participation in the Superfund cleanup process. Open Meeting of the Industrial Non-Hazardous Waste Stakeholders Focus Group October 6, 2000 (65 FR 59836) EPA gave notice of the seventh meeting of the Industrial Non-Hazardous Waste Policy Dialogue Committee, also known as the Industrial Non-Hazardous Waste Stakeholders Focus Group. The purpose of this meeting is to review and discuss issues associated with the public comments received on the Draft Guide for Industrial Waste Management. Interagency Project To Clean Up Open Dumps on Tribal Lands: Request for Proposals October 12, 2000 (65 FR 60662) The national Tribal Solid Waste Interagency Workgroup solicited proposals for its Tribal Open Dump Cleanup Project for fiscal year (FY) 2001. In FY 2000 the Workgroup made $2.4 million available to fund or partially fund 11 proposed projects. The Workgroup believes that a similar dollar amount will be available to fund projects in FY 2001. In selecting Cleanup Project proposals, the Workgroup plans to use a two-step process. The first step is to submit a pre- proposal, which generally outlines the proposed project and provides a general budget estimate. The second step of the proposal submission process is to submit a full proposal. For consideration, pre-proposals must be received by close of business on November 13, 2000, and full proposals must be received by close of business on February 23, 2001. Regulatory Reinvention (XL) Pilot Projects October 23, 2000 (65 FR 63250) EPA announced the availability of Final Project Agreements and related documents for twenty-two XL Projects. CERCLA Announcement of Proposal Deadline for the Competition for the FY 2001 Brownfields Cleanup Revolving Loan Fund Pilots October 11, 2000 (65 FR 60429) EPA announced that it would begin to accept proposals for the FY 2001 Brownfields Cleanup Revolving Loan Fund Pilots on October 11, 2000.
