This Erratum corrects portions of the final rules in the Report and Order in the above- captioned proceeding, FCC 99-12, released on March 26, 1999 ("Order"), as corrected by the Erratum released on April 27, 1999 ("April 27th Erratum"). These errors will be corrected prior to publication of the Order in the Federal Register and in the FCC Record. 2. The following corrections to Appendix C of the April 27th Erratum have been made: (A) Paragraph 7, Note 1 is corrected to state, in relevant part, "the operator must comply with the notification provisions of  76.1620."; (B) Paragraph 7, Note 2 is corrected to state, in relevant part, "as provided by  76.1614."; (C) Paragraph 10 is corrected to state, in relevant part, "Employment data on the annual employment report (FCC Form 395A) required by 76.1802 shall reflect the figures from any one payroll period in July, August, or September of the year during which the report is filed."; (D) Paragraph 27, Note 2 is corrected to state, in relevant part, "in accordance with  76.1717."; (E) Paragraph 34, Note 2 is corrected to state, in relevant part, "in accordance with  76.1621."; (F) Paragraph 34, Note 3 is corrected to state, in relevant part, "in accordance with  76.1622."; (G) Paragraph 41 is deleted and the subsequent paragraphs are renumbered; (H) Paragraph 46, Section 76.1603, Note 1 is corrected to state "Section 624(h) of the Communications Act, 47 U.S.C.  544(h), contains additional notification requirements which a franchising authority may enforce."; (I) Paragraph 46, Section 76.1603, Note 2 is corrected to state "Section 624(d)(3) of the Communications Act, 47 U.S.C.  544(d)(3), contains additional notification provisions pertaining to cable operators offering a premium channel without charge to cable subscribers who do not subscribe to such premium channel."; (J) Paragraph 46, Section 76.1603, Note 3 is corrected to state "Section 631 of the Communications Act, 47 U.S.C.  551 contains additional notification requirements regarding protection of subscriber privacy."; (K) Paragraph 47, Section 76.1700 is corrected as follows: "(a) Recordkeeping requirements. The operator of every cable television system having fewer than 1,000 subscribers is exempt from the public inspection requirements contained in  76.1701 (political file); 76.1715 (sponsorship identifications); 76.1702 (EEO records available for public inspection); 76.1703 (commercial records for children's programming); 76.1704 (proof-of-performance test data); and 76.1706 (signal leakage logs and repair records). The operator of every cable television system having 1000 or more subscribers but fewer than 5000 subscribers shall, upon request, provide the information required by 76.1715 (sponsorship identifications); 76.1702 (EEO records available for public inspection); 76.1703 (commercial records for children's programming); 76.1704 (proof-of-performance test data); and 76.1706 (signal leakage logs and repair records) but shall maintain for public inspection a file containing a copy of all records required to be kept by 76.1701 (political file).
