Residues From the Trial Burn of Listed Hazardous Wastes To obtain a RCRA permit for a hazardous waste incinerator, permit applicants must conduct a trial burn to demonstrate that their incinerator has the ability to burn wastes, cleanse combustion gases, and emit only harmless quantities of pollutants to the atmosphere (40 CFR Section 270.62(b)). For example, a facility seeking a RCRA incinerator permit mixes a listed Section 261.33 chemical reagent with sand for the purposes of feeding it into the combustion chamber of the incinerator during a trial burn. The mixture of the chemical reagent and the sand is a listed hazardous waste per Section 261.3(a)(2)(iv). Is the residue from the trial burn of this hazardous waste mixture also a listed hazardous waste? The residue from the trial burn of the hazardous waste mixture is a listed hazardous waste via the derived-from rule (Section 261.3(c)(2)(i)). A permit applicant is not absolved from identifying solid and hazardous waste generated from a trial burn. According to the derived-from rule, any solid waste generated from the treatment, storage, or disposal of hazardous waste, including any sludge, spill residue, ash, emission control dust, or leachate is a hazardous waste (Section 261.3(c)(2)(i)). Therefore, ash residue from the incineration of a listed hazardous waste is subject to regulation as a hazardous waste. UST 2. Septic Tank Exclusion for Underground Storage Tanks A septic tank is a water-tight, covered receptacle designed to receive or process, through liquid separation or biological digestion, the sewage discharged from a building sewer. The effluent from such a receptacle is distributed for disposal through the soil, and settled solids and scum from the tank are pumped out periodically and hauled to a treatment facility (40 CFR Section 280.12). The definition of an underground storage tank (UST) specifically excludes septic tanks; therefore, septic tanks are not subject to any Part 280 requirements (RCRA Section 9001(1)(C) and Section 280.12). Does the septic tank exclusion apply to all septic tanks, or only to those that are residential septic tanks? Is the septic tank exclusion limited to the septic tank, or does the exclusion include the entire septic tank system? The legislative history of the septic tank exclusion indicates that Congress intended this exclusion to apply to all septic tanks, not just residential tanks (52 FR 12662, 12691; April 17, 1987). Whether the entire septic tank system is excluded depends on the status of the septic tank itself. EPA only regulates tank systems under Part 280 if the tank meets the definition of an UST in Section 280.12. Since septic tanks are specifically excluded from the definition of UST, the entire septic system, including such components as a distribution box, dosing tank, and grease trap, is excluded. CERCLA 3. Role of the Baseline Risk Assessment in Superfund Response Actions The purpose of the Superfund program is to address threats to human health or the environment resulting from releases or potential releases of hazardous substances from abandoned or uncontrolled contaminated sites. EPA performs a baseline risk assessment during the remedial investigation stage of the Superfund response process to examine the potential health risks from exposure to chemicals found at a site if EPA takes no cleanup action (40 CFR Section 300.430(d)(4)). How does EPA perform a baseline risk assessment and use and document the results of the baseline risk assessment in the Superfund response process? A baseline risk assessment is the estimation of potential health risks resulting from exposure to chemicals found at a site if EPA takes no cleanup action. It includes four steps: data collection and evaluation, exposure assessment, toxicity assessment, and risk characterization. In the first step, risk assessors evaluate data from samples collected at the site to determine the type and amount of chemicals present. In the second step, risk assessors determine the potential for people or animals to come in contact with chemicals found at the site. As part of an "exposure assessment," the risk assessor looks at which media are contaminated (e.g., soil, air, and water) and the potential for exposure to those media (e.g., people drinking groundwater). In the third step, risk assessors gather information regarding the toxicity of the chemicals identified in the data collection and evaluation process. EPA has performed toxicity assessments for numerous chemicals and has made available the resulting information following extensive peer review. At some sites, however, there may be significant data analysis issues that should be addressed by an experienced toxicologist. Finally, risk assessors combine, evaluate, and summarize the data collected in the first three steps to determine the overall risk posed to the community if the site is not cleaned up. Though the process for conducting baseline risk assessments is generally standardized, baseline risk assessments may vary both in detail and extent to which qualitative and quantitative analyses are used, depending on the complexity and particular circumstances of the site. They often provide the basis for determining whether a remedial action is warranted at a site. The results of the baseline risk assessment can also be used, in combination with chemical-specific applicable or relevant and appropriate requirements (ARARs), to help establish preliminary cleanup levels for use in evaluating remedial alternatives during the feasibility study (FS). Generally, the "Summary of Site Risks" section of the record of decision (ROD) describes the results of the baseline risk assessment in its discussion of the risks associated with current and future land use. In addition, the ROD should include an explanation of how the remedy will eliminate, reduce, or control unacceptable risks identified in the baseline risk assessment. NEW PUBLICATIONS How to order... FEDERAL REGISTERS Federal Register Availability FINAL RULES RCRA "Hazardous Waste Management System; Modification of the Hazardous Waste Program; Hazardous Waste Lamps; Final Rule" July 6, 1999 (64 FR 36466) EPA added hazardous waste lamps to the federal list of universal wastes regulated under the RCRA. The Agency concluded that regulating spent hazardous waste lamps as a universal waste under 40 CFR Part 273 will lead to better management of these lamps and will facilitate compliance with hazardous waste requirements. EPA promulgated less stringent standards for handlers of universal wastes for storing, transporting, and collecting these wastes. The final rule is effective on January 6, 2000. "Project XL Rulemaking for New York State Public Utilities; Hazardous Waste Management Systems; Final Rule" July 12, 1999 (64 FR 37624) EPA allowed participating New York State Utilities to consolidate hazardous waste, which they generate at remote locations, at designated Utility-Owned Central Collection Facilities (UCCFs) for up to 90 days subject to specified requirements. EPA promulgated this rule to implement an XL project for Utilities in New York State. The terms of the XL project are defined in the Final Project Agreement (FPA) which is scheduled to be signed on July 12, 1999. The requirements of this rule will not take effect in New York State until it adopts the requirements as state law. The final rule is effective on January 10, 2000. CERCLA "National Priorities List for Uncontrolled Hazardous Waste Sites; Final Rule" July 22, 1999 (64 FR 39878) This rule adds a total of 15 new sites to the NPL: 13 sites to the General Superfund Section of the NPL and two sites to the Federal Facilities Section of the NPL. All Programs "Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties, Issuance of Compliance or Corrective Action Orders, and the Revocation, Termination or Suspension of Permits; Final Rule" July 23, 1999 (64 FR 40138) EPA revised the Consolidated Rules of Practice (CROP), including expansion of these procedural rules to include certain permit revocation, termination and suspension actions, and new rules for administrative proceedings not governed by section 554 of the Administrative Procedure Act. The Rule removed inconsistencies, fills in gaps in the CROP by codifying accepted procedures, and make the CROP more clear and easily understood. This rule is effective August 23, 1999. PROPOSED RULES RCRA "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Dye and Pigment Industries; Land Disposal Restrictions for Newly Identified Wastes; CERCLA Hazardous Substance Designation and Reportable Quantities; Proposed Rule" July 23, 1999 (64 FR 40192) EPA proposed to list two of three wastes from the dyes and pigment industries as hazardous wastes under RCRA. EPA proposed concentration-based listings for the two wastes, such that waste generators have the option of determining that their specific waste is nonhazardous. To classify their waste as nonhazardous, generators must determine the levels of constituents in their wastes, and certify to EPA that their wastes are below the regulatory levels of concern. EPA is accepting comments on this proposed rule until September 21, 1999. "Project XL Site-Specific Rulemaking for University Laboratories at the University of Massachusetts Boston, Boston, MA; the Boston College, Chesnut Hill, MA; and the University of Vermont, Burlington, VT; Proposed Rule" July 27, 1999 (64 FR 40696) EPA proposed to implement a project under Project XL program that would provide regulatory flexibility under RCRA as amended for the University of Massachusetts-Boston, Boston, MA, Boston College, Chestnut Hill, MA and the University of Vermont, Burlington, VT (the Universities). The principal objective of this project is to pilot a flexible, performance-based system for managing laboratory waste. EPA provided regulatory flexibility to allow the participating laboratories at the Universities to replace existing requirements for hazardous waste generators with a comprehesive Laboratory Environmental Management Plan designed for each university. The terms of the overall XL project are contained in the Final Project Agreement (FPA) on which EPA is also requesting comments. Comments on this proposed rule must be received by August 26, 1999. CERCLA "National Priorities List for Uncontrolled Hazardous Waste Sites; Proposed Rule" July 22, 1999 (64 FR 39886) This rule proposes to add 11 new sites to the NPL: 10 sites are being proposed to the General Superfund Section of the NPL and one site is being proposed to the Federal Facilities Section. "National Priorities List; Mason County Landfill Superfund Site" July 26, 1999 (64 FR 40328) Notice of Intent to Delete. NOTICES RCRA "Transfer of Confidential Business Information to Contractors" July 7, 1999 (64 FR 36682) EPA transferred to its contractors, ERG Inc. and Science Applications International Corporation (SAIC) Confidential Business Information (CBI) that has been or will be submitted to EPA under Section 3007 of RCRA. "Underground Injection Control Program, Hazardous Waste Injection Restrictions; Petition for Exemption-Class I Hazardous Waste Injection; ASARCO Inc." July 12, 1999 (64 FR 37532) EPA granted an exemption from the land disposal restrictions (LDR) to ASARCO, Inc., for three Class I injection wells located at Amarillo, Texas. ASARCO adequately demonstrated to the satisfaction of EPA that, to a reasonable degree of certainty, there will be no migration of hazardous constituents from the injection zone for as long as the waste remains hazardous. This final decision allows ASARCO, Inc. to inject hazardous wastes into three Class I hazardous waste injection wells until July 1, 2009, unless EPA moves to terminate the exemption under provisions of 40 CFR Section 148.24. "RCRA Subtitle C Waste Facility Social Siting Criteria Stakeholders' Roundtable" July 13, 1999 (64 FR 37784) EPA announced it will hold a roundtable discussion on community quality of life issues (i.e., cultural, social, economic, and nuisance) related to the siting of RCRA Subtitle C hazardous waste facilities. The roundtable panel will include individuals who have substantial experience in many aspects of facility siting. The purpose of this roundtable panel is to offer their own evaluations and suggestions on an EPA draft social siting criteria brochure and possible mechanisms and tools for conflict resolution regarding facility siting. The meeting will be held on July 27, 1999. "Agency Information Collection Activities: Continuing Collection; Comment Request; Part B: Permit Application, Permit Modifications and Special Permits" July 23, 1999 (64 FR 39986) EPA announced it is planning to submit the following continuing Information Collection Request (ICR) to the Office of Management and Budget (OMB) in compliance with the Paperwork Reduction Act) 44 U.S.C. 3501) : Part B Permit Application, Permit Modifications and Special Permits, EOA ICR #1573.05, OMB No. 2050-0009 expires on December 31, 1999. "Potential Revisions to the Land Disposal Restrictions Mercury Treatment Standards; Extension of Comment Period" July 27, 1999 (64 FR 40534) EPA extended the comment period for the Agency's request for comment on potential revisions to the mercury-bearing hazardous waste regulations presented in an advanced notice of proposed rulemaking (ANPRM) published May 28, 1999 (64 FR 28949). The ANPRM requested comment on EPA's waste generation and treatment data for mercury-bearing hazardous waste, as well as on technical and policy issues regarding mercury waste treatment, and potential avenues by which current mercury treatment standards might be revised.
