Original Document: Yes, AIRFA focuses on federally recognized tribes; that's what the definitional language means. But be cautious in NOT respecting the religious beliefs of a non-recognized tribe, because (a) the tribe might GET recognized tomorrow; (b) the Religious Freedom Restoration Act (RFRA) demands that attention be given to everybody's religious beliefs and practices; (c) the non-recognized tribe is doubtless a minority group, and likely to be low-income, so environmental justice can be an issue, and (d) there's always the Free Exercise clause of the First Amendment to the constitution.
