Gary Stephen Kaplan arraignment held before U.S. Magistrate Mary Ann Medler. Defendant pled not guilty. Evidentiary hearing set for June 4, 2007.

April 4, 2007

Removal, identity and detention hearing for Gary Stephen Kaplan was held in Puerto Rico. Defendant waived identity hearing and reserved right to request bail in Eastern District of Missouri. Magistrate judge ordered defendant be detained, as a flight risk. Defendant will be removed to the Eastern District of Missouri.

March 30, 2007

Gary Kaplan arrested in Dominican Republic. Kaplan has been sent to Puerto Rico for initial appearance. Press Release

February 5, 2007

Order signed by U.S. District Judge Carol E. Jackson finding BETONSPORTS PLC, its officers and directors to be in contempt of the authority of the Court and that each shall pay to the United States a $5,000 fine per day, beginning on February 2, 2007, and continuing until BETONSPORTS PLC satisfies the Court that it is no longer in contempt.

September 19, 2006

Status conference regarding temporary restraining order (TRO) held before U.S. District Judge Carol E. Jackson. TRO extended and shall remain in full force until Monday, October 16, 2006.

August 31, 2006

Status conference regarding temporary restraining order (TRO) held before U.S. District Judge Carol E. Jackson. Government reported to the Court its continuing efforts to serve BETONSPORTS PLC in London. Government also reported that it is continuing discussions with BETONSPORTS PLC counsel, in an attempt to have the company waive service.

The Court granted Government's request to have the TRO extended for another 30 days.

Bond hearing held before U.S. Magistrate Judge Mary Ann Medler. David Carruthers released on $1 million bond and placed on electronic monitoring.

August 14, 2006

Status conference held before District Judge Carol E. Jackson. Defendant BETONSPORTS PLC did not appear. Government's request for an extension of TRO granted. TRO extended until September 1, 2006.

July 31, 2006

U.S. Magistrate Judge Mary Ann L. Medler arraigned individual defendant David Carruthers, who was in custody. Carruthers waived a hearing on his detention status, in anticipation of being able to post bond and meet conditions of supervision acceptable to the Court, Pretrial Services and the United States. Carruthers' counsel is to contact the United States as soon as appropriate arrangements are made and will then move for the defendant's release from custody.

District Judge Carol E. Jackson held a hearing on the Complaint and Motion for Injunctive Relief filed by the United States. Defendant BETONSPORTS PLC did not appear. Counsel for the United States reported that Mr. Steve Cohen, who had been retained to advise BETSONSPORTS PLC stated that his client had declined to appear at this time. Counsel for the United States reported efforts to serve BETONSPORTS PLC with the Complaint and Summons, after criminal defendant David Carruthers, formerly a Director of BETONSPORTS PLC, was fired by the company. The United States is to file a Notice, detailing the service on BETONSPORTS PLC, and why the Court should accept that service as adequate. In the alternative, the United States will ask the Court to continue the TRO to allow service on BETONSPORTS PLC under the Hague Convention. The Court continued the TRO until August 14, 2006.

Arraignments for all defendants in custody before U.S. Magistrate Judge Mary Ann Medler:

Judge Medler issued Pretrial Orders to all of the defendants setting an initial hearing for pretrial motions on August 21, 2006. The Judge acknowledged that this date was in all likelihood unrealistic, in light of the Motion to Designate as a Complex Case filed by the United States, and the necessity for a lengthy period for disclosure, as described by the United States. The United States also filed a Motion for Protective Order, to require those receiving copies of documents not to disseminate them, or use them for any purpose outside this case. Those motions are under consideration, and will be signed either by Magistrate Judge Medler or District Judge Jackson. All defense counsel stated they had no objection to the designation as a complex case. All counsel stated that they wished more time to review the Government's Motion for Protective Order.

Corporate defendants Direct Mail Expertise (DME), Mobile Promotions and BETONSPORTS PLC failed to appear by any legal representative. The United States is considering what sanctions it may request regarding these defendants.

July 26, 2006

Status conference held in front of U.S. District Judge Carol E. Jackson. Extension of Temporary Restraining Order against Betonsports PLC granted to July 31, 2006.

July 21, 2006

Defendant David Carruthers appeared in federal court in Northern District of Texas and was ordered detained and removed to the Eastern District of Missouri.

July 17, 2006

Indictment unsealed and press release issued.

Complaint for a Temporary Restraining Order, Preliminary and Permanent Injunction and Other Equitable Relief against Betonsports PLC filed by USA. Temporary Restraining Order granted.
