Claims

A claim for any damages against the United States can arise when involving activities of NASA which result in injury or loss of property or death. 14 CFR Part 1261.302.

Employee Personal Property Claims

All employee personal property claims are to be submitted to the Office of Chief Counsel using NASA Form 1204, "Employee Claim for Damages to or loss of Personal Property Incident to Service." Personal property is defined as anything that is owned by an individual with the exception of real estate.

In addition to the information requested on NASA Form 1204, any other incident in support of the claim is required. This can include statements from others who have personal knowledge of facts concerning the claim, itemized repair bills, and/or written estimates for repairs or replacement.

Claim for Damage, Injury or Death

(Federal Tort Claim Act)

Any claims for injury, death or loss of property are to be submitted to the Office of Chief Counsel of the NASA Installation whose activities are believed to have given rise to the injury, death or property loss. If the identity of the installation is unknown, the claim should be submitted to the General Counsel of NASA. All claimants must submit a complete Standard Form 95, "Claim for Damage, Injury or Death." The claim should be substantiated by competent endorsee such as supporting statements and estimates. A claim must be presented to NASA within 2 years of the incident or accident of which the claim arose.
