The following is a status update for all inquiries.

*The format of the Weekly Status Report will appear as follows:

"The U.S. Patent and Trademark Office is processing paper Madrid filings within a week of receipt and electronic applications within hours. Information is generally viewable on the USPTO website within 24 hours of the completion of Trademark processing. In addition to the work done on Madrid filings at the USPTO, there is also processing at the International Bureau of WIPO. Thus, in certain circumstances pendency is influenced by any backlogs that might develop at WIPO."

Availability of Files:

On the weekend of April 9 and April 10 2005, the USPTO computer Lab moved from the Crystal City (Arlington) Campus to the Alexandria Campus.

As part of the move, the four USPTO main web routers were to be upgraded (two in Arlington), and (two in Alexandria).

This update was not expected to have had an impact on "passive" mode FTP transfers from the Data File Delivery (DFD) FTP System or the USPTO web pages; however, external users were unable to access the USPTO site.

Load-leveling between the four USPTO main web routers was determined not to be working properly and might have been the source of intermittent access availability in the past.

As of April 25, 2005 the USPTO has modified its firewall rules for transfers from the Data File Delivery (DFD) FTP System or the USPTO web pages.

Control #210:

Can you look into the possibility that the insertion of those placeholders in the C files caused them to come in as TX records, and not NA records when they come in for the first time with full data. I noticed that all the placeholders were 78 series, no 76 series and I also noticed that NA records in the C files are all 76s, no 78s. Would the elimination of the placeholders from the C files allow the 78 series records to come in as NA records?

An additional validation was added to the software to prevent a partial record from being placed into the daily file. This additional validation requires that a record with a status code of 630 (New Application) must have a filing date.

Control #211:

Our logs indicate that apc050405 contain duplicate serial numbers and we cannot process the file as is.

Further analysis reveals 6180 KA (OG) records in Apc050405.xml. 6180 is the total number of duplicate serial numbers found. I looked at a handful of the dupes and found that each appeared as a KA record and a TX record.

The process has been updated to compare Monday's OG records with Tuesday's TX records and eliminate duplicate Serial Numbers.

Control #214:

The following files were not present, in a timely manner, on the Data File Delivery (DFD) FTP System:

The files were not present because the processing server had no available space during weekend processing. The thresholds that determines available server space has been increased to ensure that more than enough space is available at all times.

Control #215:

In the interest of economy, can something be done to filter out records from the application daily “C” files that have not undergone any change? We find recurring serial numbers where there are no detectable difference in the record.

Normal business processing of trademarks applications may cause records to appear unchanged to the external customer, however this internal trademark processing may cause an update unrelated to the application data.

Control #216:

Madrid application changes are not being disseminated. Serial No.: 71/431251 has had many <Madrid-history-events> recently added to it, yet the last update from was June 11, 2004. There were 2 updates this month on April 1st and 12th yet we did not receive these in any of the daily files.

The XML "C" retrospective dated March 31st, 2005 contains the Madrid information up to January 20th, 2005.

This error was corrected Wednesday, April 27, 2005. All missing history event data records (approximately 780 records - this number may contain duplicate serial numbers for different days) will be provided as soon as possible.

Please clarify why we received the bulk of 79 series codes on one day during the month of April 2005.

A process was executed to update all records received from the International Bureau, causing a massive update on April 16, 2005.

Control #218:

In the apc050412, we received the following SN #75850637 where the OWNER NAME came into us as:

FOX CHILDREN&#146;S NETWORK, INC.

This ended up halting our print job and based on what I've been told from my tech here, is that codes &#128 through &#159 are printing control characters. Over the past few weeks, we have seen an increase in these type of codes coming in.

Can you have someone take a look at this record specifically -- where on the TARR database it is printing as FOX CHILDREN'S NETWORK, INC.

There are four printable characters in the range 128 through 159. 128 is the Euro symbol, 138 is an accented S, 145 and 146 are left and right angled (stylized) apostrophes.

And just to clarify, the serial number this occurred on in apc050412.xml was 75839849 and in that serial number on TARR it appears as a blank space not a standard apostrophe.
