The Court entered General Order No. 10-2008, In Re: Adoption of Interim Bankruptcy Rule 1007-I, on December 15, 2008. Consistent with the National Guard and Reservists Debt Relief Act of 2008, Interim Bankruptcy Rule 1007-I will apply to cases commenced in the three-year period beginning December 19, 2008. to add to the last sentence the additional language,
“...to the extent provided in 11 U.S.C. § 362(c)(3)(A).”

Paragraph 10 Plan Language

The Judges have approved additional suggested language for Paragraph 10 of the Chapter 13 Form Plan, to address: (1) Other allowed secured claims as to which a proof of claim is filed but which is not specifically treated in the plan; and (2) Claims subject to lien avoidance pursuant to 11 U.S.C. §522(f). Announcement of Proposed Official Forms for Plan and Disclosure Statement
in Small Business Chapter 11 Cases

          A provision of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 required the Judicial Conference of the United States to design an official form for the Chapter 11 plan of reorganization and disclosure statement for small business debtors as defined in 11 U.S.C. § 101(51D). Pub.L. 109-8, Title IV § 433, 119 Stat. 110 (2005). The Judicial Conference has approved these forms, and the Small Business Chapter 11 Plan/Official Form 25A and Disclosure Statement/Official Form 25B will become effective on December 1, 2008, if approved by the Supreme Court and Congress does not act to the contrary. As the Committee Notes accompanying these forms make clear, both Official Forms are “intended to provide an illustrative format rather than a prescription for the language or content” of either. Although these Official Forms are not yet effective and will not be mandatory, they may be useful in providing guidance as to the information and disclosures required in such cases.

Announcement for Form Stipulations

To facilitate the preparation and presentation of consent orders to resolve motions of lenders for relief from the automatic stay to foreclose on real estate in Chapter 13 cases, the Bankruptcy Judges, other than Judge Murphy, have approved the use of a form stipulation on which the parties check boxes to select applicable provisions of their agreement and fill in blanks for variable items such as the property description, the amount of arrearage, and payment terms. The parties then attach the completed stipulation form to a proposed consent order that incorporates it as the order of the Court and present it to the Bankruptcy Judge for consideration and entry, if appropriate.

The consent order, with the stipulation attached, may be submitted as an E-Order or in paper form. If the submission is not made at the hearing on the motion, the Judges encourage the submission to be made by E-Order. Use of the form is not mandatory.
The forms are available in downloadable or printable form on the “Local Forms” page of the Court’s website.
Use of the form is not permitted in cases assigned to Judge Murphy; a different version of the form stipulation and order approved by Judge Murphy for use in her cases will be posted on Judge Murphy’s section of the Court’s website.

Effective Monday, October 1, 2007, the National Archives will amend the fees it charges to reproduce public court documents in National Archives facilities nationwide. The fees are being changed to reflect current costs of providing the reproductions. This is the first fees increase in more than a decade. On Thursday, September 27, 2007, the Administrative Office of the United States Courts announced that the Electronic Public Access Fee Schedule has been amended to include court-appointed pro bono attorneys among that category of persons that a court may exempt from PACER fees upon the proper showing. This amendment is effective September 18, 2007. A copy of the amended fee schedule is available by clicking HERE .
