waiver application

In order to protect the health, welfare, and security of the U.S., certain applicants are not eligible for the issuance of a visa even if they qualify in other ways. There are specific ineligibilities written in U.S. immigration law. For example applicants must be refused visas when they have a communicable disease, or a dangerous physical or mental disorder; have committed serious criminal acts; are members of terrorists groups; or have used illegal means to enter the U.S.

If you are found to be ineligible, the consular officer will advise you regarding your ineligibilities and whether there is a possibility of obtaining a waiver.

If you are eligible to apply for a waiver, the immigrant visa unit will provide you on your interview date a letter with instructions how to apply for a waiver. Your application will be processed by the Citizenship and Immigration Services (CIS) office in Panama City, Panama. You will need to complete some forms and pay a fee.

This fee has to be paid at the American Consulate on the date of your waiver application submission. You may pay with cash or credit card VISA, Mastercard, Discover, Diners International or American Express. We do not accept $100,oo bills.

You need to print and fill out only the forms listed in the letter. Please consider the following instructions:

1. Every document not in English must be translated into the English language. You don’t need to translate the forms.

2. All documents and forms must be submitted in the same order as requested in the waiver instructions letter.  The forms must be filled out on-line.

3. Please submit two extra groups of copies of all the waiver documents requested.

Once you have complied with all the documents required you may contact our Visa Information Service (VIS) at 1-800-010-145 from Ecuador or 1-800-919-5290 from the United States to request an appointment for a waiver application. For more information on the VIS, click here.
