UNITED STATES OF AMERICA DEPARTMENT OF TRANSPORTATION OFFICE OF THE SECRETARY WASHINGTON, D.C. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - CHICAGO-LONDON COMBINATION AIR SERVICE - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - NOTICE In a Memorandum of Consultations dated June 5, 1995, representatives of the United States and the United Kingdom reached agreement on certain amendments to the Air Services Agreement between the countries set forth in a draft Exchange of Notes. Part II, Paragraph 1 of the draft Exchange of Notes provides that the United States may designate a second U.S. carrier to serve the Chicago-London market. (American Airlines is the other carrier designated to serve Chicago.) United Air Lines currently holds certificate authority on its Route 603 to serve the Chicago-London market, but has been unable to exercise this authority due to the limitations in the U.S.-U.K. aviation agreement. Based on the recent MOC, United has requested that the Department now designate it to serve the Chicago-London route. Since we may designate only one additional carrier to serve this market, we are notifying U.S. certificated air carriers that we intend to act affirmatively on United's request unless we receive competing requests for designation or operating authority by June 7, 1995. Carriers without the requisite operating authority may file pendente lite exemption applications no later than June 7, 1995. Answers to such applications shall be filed no later than June 8, 1995. Carriers already holding the requisite operating authority should request designation by June 7, 1995. Requests for certificate authority should be filed by June 21, 1995, with answers due by June 28, 1995. 1 Except for the filing dates, exemption applications should conform to the provisions of Part 302, Subpart D of our procedural regulations and certificate applications should conform to Subpart Q; both should clearly specify which London airport would be served and the proposed startup date for service. Exemption/certificate applications should be filed with the Department's Docket Section, Room PL-401, 400 Seventh St., S.W., Washington, D.C. 20590. Designation applications should be filed with the Director, Office of International Aviation, Room 6402, at the same address. Further procedures for acting on the applications filed, if necessary, will be established in a future Department order. In view of the shortened filing deadlines, we will require that the June 7 applications and any answers thereto be served on interested parties by fax. We will serve this notice on all certificated air carriers that currently hold authority from the Department to provide scheduled foreign air transportation of persons, property, and mail with large aircraft.
