To prescribe comprehensive, integrated Department of Energy (DOE) stewardship requirements for optimizing the use of nonwaste, DOE-owned or -managed, nuclear materials. b. To establish requirements and responsibilities for the Nuclear Materials Council and the Nuclear Materials Stewardship Task Force. 2. CANCELLATION. DOE 5660.1B, MANAGEMENT OF NUCLEAR MATERIALS, dated 5-26-94, is canceled. Cancellation of this Order does not in itself modify or otherwise affect contractual obligations to comply with DOE 5660.1B, which remains in effect until such contract is modified to delete any reference to DOE 5660.1B. 3. APPLICABILITY. a. General. This Order applies to nuclear materials at DOE-owned and DOE-leased facilities and DOE-owned nuclear material at other facilities. See DOE M 251.1-1B, DIRECTIVES SYSTEM MANUAL, Chapter VII, for the exemptions process to be used to obtain exemptions and waivers from this Order. b. Contractors. Except for the exclusions in paragraph 3c, any contractor who possesses, uses, or ships nuclear materials at DOE-owned or DOE-leased facilities or at other facilities must follow the Contractor Requirements Document (Attachment 1) to the extent its provisions are incorporated into a contract. c. Exclusions. This Order does not apply to DOE low-level radioactive waste, high- level radioactive waste, or transuranic waste, or to commercial spent nuclear fuel under the cognizance of the Office of Civilian Radioactive Waste Management and subject to Nuclear Regulatory Commission licensing. See paragraph 3a for the exemptions and waivers process. 4. REQUIREMENTS. DOE M 410.X-X, NUCLEAR MATERIALS STEWARDSHIP MANUAL, contains detailed requirements for stewardship of nuclear materials covered by this Order. a. Management of Nuclear Materials. The following requirements relate principally to planning and operations associated with nuclear materials stewardship at the program and site levels. (1) Nuclear materials must be effectively managed throughout their life cycles. [See paragraphs 5b(2-4), 5c(1), 5c(4), 5c(7), 5j(2-5), 5j(8), 5m(9), 5m(13), and applicable references.] (2) Resource-loaded, life-cycle management plans for nuclear materials must be prepared for each program and/or site. [See paragraph 5c(2).] (3) Nuclear materials must be provided from inventory or by other means (e.g., production, recovery, or purchase) to satisfy program needs. [See paragraph 5c(6).] (4) Excess special nuclear material must be inspected in accordance with the United States/International Atomic Energy Agency Voluntary Safeguards Agreement, other agreements, and treaties. [See paragraphs 5c(3) and 5i.] (5) Agreements with outside organizations for DOE to lend or lease nuclear materials must be administered and materials must be returned to DOE in accordance with the provisions of the contract or agreement. [See paragraph 5j(12).] b. Integration of Nuclear Materials Activities. The following requirements relate principally to coordination and integration of nuclear materials stewardship activities across programs and sites. (1) DOE functions must be coordinated to ensure (a) appropriate integration of Headquarters activities with nuclear materials initiatives and activities and (b) resolution of crosscutting issues. [See paragraphs 5a, 5b(1), 5d(1), 5e(1), 5j(1), 5k, 5l, 5m(1-4), and 5m(8).] (2) Disposition options are required for surplus nuclear materials (i.e., materials not required for DOE programs). [See paragraphs 5e(2) and 5g.] (3) National resource materials must be identified, approved, and maintained. [See paragraphs 5f, 5k(5), and 5m(5).] (4) Established DOE field nuclear material management groups must assist in the management of specified nuclear materials. [See paragraphs 5j(7) and 5m(7).] (5) Nuclear materials technology development initiatives and activities must be integrated to optimize use of limited resources. [See paragraph 5m(6).] (6) The Multi-Year Action Agenda for the Nuclear Materials Council (see paragraph 7a, Table S-2) must be updated annually in conjunction with the budgeting cycle. [See paragraph 5m(11).] c. Implementation of Nuclear Materials Management Processes. The following requirements relate principally to administration and implementation of nuclear materials management information and data management processes. (1) Nuclear materials forecasts and nuclear materials inventory assessments associated with the following must be submitted to the Office of Tritium Production, DP-25, annually: (a) DOE program and site needs to acquire, maintain, or disposition nuclear materials and (b) non-DOE (e.g., foreign research and test reactor) needs for DOE nuclear materials. [See paragraphs 5d(3) and 5j(6).] (2) The movement and recategorization of certain nuclear materials require prior approval. [See paragraph 5d(4).] (3) Nuclear materials inventory data and nuclear materials stewardship information must be provided to internal and external stakeholders, as appropriate and as requested. [See paragraphs 5c(9), 5h(2), 5j(10), and 5m(10).] (4) Administration and planning associated with nuclear materials management (e.g., nuclear materials management project numbers, materials ownership changes) must be coordinated among Headquarters elements. [See paragraphs 5c(5) and 5d(2).] (5) To integrate inventory information contained in field site and Headquarters program data systems, DOE corporate system(s) must be maintained for collecting, maintaining, and reporting specified DOE nuclear materials stewardship data. [See paragraphs 5c(8), 5e(3), 5h(1), 5j(9), and 5m(12).] (6) DOE field element and contractor nuclear materials stewardship programs and activities must be reviewed periodically for conformance to the requirements of this Order. [See paragraphs 5j(11) and 5m(14).] 5. RESPONSIBILITIES. a. Under Secretary for Energy, Science, and Environment and Under Secretary for Nuclear Security. Co-chair the Nuclear Materials Council. [See paragraph 4b(1).] b. Heads of Headquarters Elements. The following responsibilities pertain to the Offices of Defense Programs (DP); Environmental Management (EM); Defense Nuclear Nonproliferation (NN); Nuclear Energy, Science, and Technology (NE); Naval Reactors (NR); Civilian Radioactive Waste Management (RW); Science (SC); Security and Emergency Operations (SO); Environment, Safety and Health (EH); and General Counsel (GC). (1) Serve on the Nuclear Materials Council and provide representation to the Nuclear Materials Stewardship Task Force commensurate with nuclear materials stewardship responsibilities. [See paragraph 4b(1).] (2) Budget for activities associated with nuclear materials stewardship. [See paragraph 4a(1).] (3) Acquire and/or maintain personnel competence commensurate with responsibilities. [See paragraph 4a(1).] (4) Provide for program-specific training on nuclear materials stewardship policy, requirements, and guidance. [See paragraph 4a(1).] c. Heads of Headquarters Elements that Manage Nuclear Materials. The following responsibilities pertain to DP, EM, NN, NE, NR, and SC. (1) Optimize the use of and provide for cost-effective management of nuclear materials throughout their life cycles. [See paragraph 4a(1).] (2) Prepare program and/or site resource-loaded, life-cycle management plans for nuclear materials. [See paragraph 4a(2).] (3) Provide for management of excess special nuclear material subject to inspection in accordance with the United States/International Atomic Energy Agency Voluntary Safeguards Agreement, other agreements, and treaties. [See paragraph 4a(4).] (4) Issue supplementary program-specific nuclear materials stewardship guidance. [See paragraph 4a(1).] (5) Reach documented agreement with other Headquarters elements for changes in program ownership of nuclear material. [See paragraph 4c(4).] (6) Provide nuclear materials from inventory or by other means (e.g., production, recovery, or purchase) to satisfy program needs. [See paragraph 4a(3).] (7) Maintain the facility, packaging, and transportation infrastructure required to support life-cycle management of nuclear materials. [See paragraph 4a(1).] (8) Ensure that cognizant activities provide required data to DOE corporate system(s) that integrate field site and Headquarters program data systems for collecting, maintaining, and reporting DOE nuclear materials stewardship data. [See paragraph 4c(5).] (9) In consultation with the Director of the Office of Security and Emergency Operations (for accountable nuclear materials, see paragraph 7b) and with the Assistant Secretary for Environmental Management (for nonaccountable nuclear materials) (a) provide program-specific nuclear materials inventory data to internal and external stakeholders and (b) advise cognizant DOE operations and field offices on responding to site- specific requests from external stakeholders. [See paragraph 4c(3).] d. Deputy Administrator for Defense Programs within the National Nuclear Security Administration. (1) Provides a vice-chair for the Nuclear Materials Stewardship Task Force. [See paragraph 4b(1).] (2) Prepares and maintains requirements for establishing, deactivating, and reporting nuclear materials management project numbers that identify activities involving nuclear materials. [See paragraph 4c(4).] (3) Collects and consolidates data and issues summary reports for nuclear materials forecasts and nuclear materials inventory assessments submitted by the field. [See paragraph 4c(1).] (4) Issues nuclear material allotments to approve certain nuclear material movements and recategorizations. [See paragraph 4c(2).] e. Assistant Secretary for Environmental Management. (1) Provides a vice-chair for the Stewardship Task Force. [See paragraph 4b(1).] (2) Develops disposition options and plans for surplus nonweapons-capable nuclear materials. [See paragraph 4b(2).] (3) In cooperation with other Headquarters and field organizations, maintains a DOE corporate system that integrates field site and Headquarters data systems for collecting, maintaining, and reporting nonaccountable DOE nuclear materials stewardship data. [See paragraph 4c(5).] f. Director of the Office of Nuclear Energy, Science and Technology. Maintains designated national resource materials according to acceptance criteria and the definition given in DOE M 410.X-X. [See paragraph 4b(3).] g. Director of the Office of Fissile Materials Disposition through the Deputy Administrator for Defense Nuclear Nonproliferation within the National Nuclear Security Administration. Develops disposition options and plans for surplus weapons-capable nuclear materials. [See paragraph 4b(2).] h. Director of the Office of Security and Emergency Operations. (1) In cooperation with other Headquarters and field organizations, maintains an integrated inventory information system for collecting, maintaining, and reporting accountable nuclear materials stewardship data. [See paragraph 4c(5).] (2) In consultation with pertinent Headquarters and field organizations, provides DOE-accountable nuclear materials inventory data to internal and external stakeholders. [See paragraph 4c(3).] i. Deputy Administrator for Defense Nuclear Nonproliferation within the National Nuclear Security Administration. Provides policy guidance and funding for preparations and inspections of excess special nuclear material in accordance with the United States/International Atomic Energy Agency Voluntary Safeguards Agreement, other agreements, and treaties. [See paragraph 4a(4).] j. Managers of DOE Field Elements that Manage Nuclear Materials and that Report to a Headquarters Element. (1) Participate on the Nuclear Materials Council and provide representation to the Nuclear Materials Stewardship Task Force. [See paragraph 4b(1).] (2) In conjunction with cognizant Headquarters offices, optimize the use of and provide for cost-effective management of nuclear materials throughout their life cycles. [See paragraph 4a(1).] (3) Issue supplementary operations/field office-specific nuclear materials stewardship guidance based on direction received from DOE Headquarters. [See paragraph 4a(1).] (4) Acquire and/or maintain personnel competence commensurate with responsibilities. [See paragraph 4a(1).] (5) Provide for site-specific training on nuclear materials stewardship policy, requirements, and guidance. [See paragraph 4a(1).] (6) Annually submit nuclear materials forecasts and nuclear materials inventory assessments to the Office of Tritium Production (DP-25). [See paragraph 4c(1).] (7) Operate DOE field nuclear materials management groups for specified nuclear materials. [See paragraph 4b(4).] (8) Maintain the facility, packaging, and transportation infrastructure required to support life-cycle management of nuclear materials. [See paragraph 4a(1).] (9) Ensure DOE corporate systems are provided data required to integrate field site and Headquarters program data systems for collecting, maintaining, and reporting nuclear materials stewardship data. [See paragraph 4c(5).] (10) In consultation with the cognizant Headquarters element(s), provide site- specific nuclear materials inventory data to external stakeholders. [See paragraph 4c(3).] (11) Conduct periodic appraisals of DOE contractor nuclear materials stewardship programs and activities for conformance to the requirements of this Order. [See paragraph 4c(6).] (12) Unless an administrative arrangement has been reached with another operations or field office, administer agreements originating within the operations or field office with outside organizations for DOE loan/lease of nuclear materials and arrange return of materials to DOE in accordance with the provisions of the contract or agreement. [See paragraph 4a(5).] k. Nuclear Materials Council. [See paragraph 4b(1).] (1) Promote and oversee responsible management of nuclear materials throughout their entire life cycles. (2) Approve the mission, goals, policies, and project deliverables associated with DOE Nuclear Materials Stewardship. (3) Act on policy issues that are in dispute and cannot be resolved by the Nuclear Materials Stewardship Task Force. (4) Work to better meet mission requirements, reduce vulnerabilities posed by existing materials and aging facilities, and develop solutions for disposal of material for which the nation has no current or future use. (5) Approve the designation of National Resource Materials. [See paragraph 4b(3).] l. Nuclear Materials Stewardship Task Force. [See paragraph 4b(1).] (1) Conduct analyses through working groups to formulate recommendations for improved management of nuclear materials. (2) Provide recommendations for approval by the Nuclear Materials Council. (3) Support near-term decisions and actions that will have a long-term impact on nuclear materials stewardship. (4) Support decisions to achieve operational improvements. (5) Facilitate long-term planning that supports DOE corporate strategy and long- term missions for the future of the nuclear materials complex. m. Director of the Office of Nuclear Materials Management Policy. (1) Chairs the Nuclear Materials Stewardship Task Force and provides executive secretariat support to the Nuclear Materials Council. [See paragraph 4b(1).] (2) Facilitates communication and coordination across program elements that have nuclear materials responsibilities and pursues integration of the Department's national security, nonproliferation, energy production, science and technology, and environmental management missions. [See paragraph 4b(1).] (3) Acts as a catalyst for resolving cross-program issues that impede effective and efficient nuclear materials management. [See paragraph 4b(1).] (4) Serves as the Department's nuclear materials management policy liaison with other Executive branch agencies and other agencies, institutions, and organizations. [See paragraph 4b(1).] (5) Coordinates identification of national resource materials. [See paragraph 4b(3).] (6) Facilitates integration of nuclear materials technology development initiatives throughout the Department. [See paragraph 4b(5).] (7) Provides a mechanism to coordinate activities associated with DOE field nuclear materials management groups. [See paragraph 4b(4).] (8) Assesses DOE management of the Nation's programmatic, reserve, and surplus nuclear materials and pursues policies and strategies to ensure effective and efficient nuclear material stewardship in both the near- and long-term. [See paragraph 4b(1).] (9) Provides for Department wide training on nuclear materials stewardship policy, requirements, and guidance. [See paragraph 4a(1).] (10) Provides DOE corporate nuclear materials stewardship information to internal and external stakeholders. [See paragraph 4c(3).] (11) In coordination with Headquarters and field organizations, annually updates the Multi-year Action Agenda for the Nuclear Materials Council (see paragraph 7a) in conjunction with the budgeting cycle. [See paragraph 4b(6).] (12) Directs the DOE corporate Nuclear Materials Information Management Project. [See paragraph 4c(5).] (13) Facilitates DOE integrated facility and infrastructure planning with respect to nuclear materials. [See paragraph 4a(1).] (14) Conducts periodic reviews of nuclear materials stewardship programs and activities at DOE field elements for conformance to the requirements of this Order. Systematically plan, document, and execute the management of DOE-owned or -managed nuclear materials and assist the Government in planning, executing, and evaluating the management of DOE-owned or -managed nuclear materials in accordance with the requirements of DOE O 410.X, NUCLEAR MATERIALS STEWARDSHIP. 2. Assist the Government in managing its nuclear materials and associated facilities to meet mission and national resource requirements while maintaining adequate protection for the workers, the environment, and the public during their generation, processing, use, storage, transportation, and disposal. 3. Comply with the requirements in DOE M 410.X-X, NUCLEAR MATERIALS STEWARDSHIP MANUAL, unless such activities are specifically excluded by DOE O 410.X, paragraph 3c. 4. Incorporate these requirements into the contracts of all subcontractors involved in the management of DOE-owned or -managed nuclear materials.
