(LAI) appealed the decision of the Respondent Small Business Administration (SBA) terminating LAI from the 8(a) program. As a result of settlement negotiations, on October 5, 1998, LAI moved to dismiss its appeal with prejudice because the parties have settled this matter and signed a Settlement Agreement. See 13 C.F.R. Section 134.217 (1998). The Settlement Agreement provides that LAI withdraws from the 8(a) program, and that LAI expressly waives all rights to SBA and judicial review. The Settlement Agreement is approved; the Motion to Dismiss is GRANTED; and the appeal is DISMISSED. The Settlement Agreement is hereby incorporated into and made a part of this Order, which will have the same force and effect as a decision. 13 C.F.R. Section 134.226 (1998). Subject to 13 C.F.R. Section 134.408(c), [1] this is the final decision of the Small Business Administration; it is binding upon all parties, including those within the employ of the Agency. 15 U.S.C.
