SQGs accumulating hazardous waste in tanks must only comply with Section 265.201, not all of Part 265, Subpart J (Section 262.34(d)(3)). SQG tank standards consist of general operating, inspection, and closure requirements, as well as special requirements for accumulating ignitable, reactive, or incompatible wastes. Only large quantity generators (LQGs) and interim status facilities are subject to full Part 265, Subpart J requirements for hazardous waste tanks. RCRA requires secondary containment for hazardous waste tanks in Section 265.193. Does this requirement extend to the piping, which is part of the tank's ancillary equipment as defined in Section 260.10? Ancillary equipment, including piping, must have full secondary containment as outlined in Section 265.193(f). However, aboveground piping is not subject to secondary containment requirements if it is visually inspected on a daily basis for leaks (Section 265.193(f)(1)). Whose responsibility is it to notify EPA of an intent to export hazardous waste? It is the primary exporter's responsibility to notify EPA of an intent to export hazardous waste. Notification of an intent to export must be sent by the primary exporter to the Office of Enforcement and Compliance Assurance no more than 60 days prior to the initial off-site shipment of waste out of the United States. The notification must be in writing, signed by the primary exporter, and include information such as the quantity of waste and the rate at which it will be shipped, as well as the mode of transportation and the name of the foreign destination facility (Section 262.53). When and where must an owner or operator of a facility subject to EPCRA Section 311 submit the Material Safety Data Sheet (MSDS) for a hazardous chemical that exceeds the minimum threshold level? The owner or operator of a facility subject to EPCRA Section 311 must submit an MSDS for a hazardous chemical to the state emergency response commission, local emergency planning committee, and local fire department. The MSDS must be submitted within three months of the chemical exceeding the minimum threshold level (Section 370.21(c)(2)). When must a Spill Prevention Control and Countermeasure (SPCC) Plan be reviewed and evaluated for a facility that was in operation before the effective date of the July 17, 2002 final rule (67 FR 47042)? The SPCC Plan for a facility that was in operation on or before August 16, 2002 (i.e., the effective date of the final rule) must be reviewed and evaluated five years from the date of the last review required in Part 112 (Section 112.5(b)). When an owner or operator of a facility subject to the requirements in Part 112 reviews and evaluates its SPCC Plan, how should the review and evaluation be documented? The owner or operator must document the completion of an SPCC Plan's review and evaluation by a signed statement indicating whether the Plan was amended. This statement should be included at the beginning, at the end, or in a log or appendix to the Plan. To document completion of the review, owners and operators may use the following statement: "I have completed review and evaluation of the SPCC Plan for (name of facility) on (date) and will (will not) amend the Plan as a result" (Section 112.5(b)). Any statement to the same effect will also fulfill the requirement (67 FR 47042, 47092; July 17, 2002). CALL CENTER QUESTIONS AND ANSWERS RCRA Frequently Asked Questions on Generator Treatment 1. Are small quantity generators (SQGs) and large quantity generators (LQGs) allowed to treat hazardous waste on site without obtaining a permit? SQGs and LQGs may treat hazardous waste on site without a permit provided they are in compliance with the applicable provisions in 40 CFR Section 262.34, and provided that the treatment is not thermal treatment (51 FR 10146, 10168; March 24, 1986). For example, in order to treat hazardous waste without a permit, an LQG must be accumulating hazardous waste on site for less than 90 days in accordance with Section 262.34, and the waste must be placed in generator accumulation units that are in compliance with Part 265, Subparts I, J, W, and/or DD. Generators should check with their implementing agencies before treating waste in accordance with Section 262.34. Some authorized states are more stringent than the federal program and require a permit for generator treatment activities. 2. Is a conditionally exempt small quantity generator (CESQG) allowed to treat hazardous waste on site without obtaining a permit? CESQGs may treat or dispose of hazardous waste on site without a permit if the facility meets one of the conditions listed in Sections 261.5(g)(3)(iii) through (vii). If a CESQG does not meet one of these conditions, the facility must have a permit under Part 270, or operate in interim status under Parts 270 and 265 before treating or disposing of waste on site (Sections 261.5(g)(3)(i) and (ii)). 3. May a generator conduct thermal treatment without obtaining a permit? A generator may not conduct thermal treatment without a permit. Thermal treatment is regulated under Part 265, Subpart P; Part 264/265, Subpart O; Part 264, Subpart X; or Part 266, Subpart H. The generator "permit exemption" for treatment only extends to treatment activities that share the same standards as storage (i.e., the treatment must occur in tanks, containers, or containment buildings). The standards for thermal treatment are different from Section 262.34 storage requirements; therefore, thermal treatment may not be performed in generator accumulation units without a permit. 4. May a SQG treat hazardous waste in containment buildings or on drip pads? A SQG cannot treat in containment buildings or on drip pads and continue to operate under the reduced requirements for SQGs set forth in Section 262.34(d). Containment buildings and drip pads are LQG accumulation units (Sections 262.34(a)(iii) and (iv)). A SQG may treat hazardous waste in containment buildings or on drip pads if the generator complies with the more stringent LQG requirements, such as personnel training and contingency plans as required in Section 262.34(a)(4). In addition, a SQG would have to close those accumulation units in accordance with Sections 265.111(a) and (b), and Section 265.114, as well as comply with a 90-day accumulation period rather than a 180-day accumulation period. FINAL RULES RCRA "Ohio: Final Authorization of State Hazardous Waste Management Program Revision" January 24, 2003 (68 FR 3429) Ohio applied for final authorization of changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA determined that these changes satisfy all requirements needed to qualify for final authorization and authorized the state's changes through this rule. This final authorization becomes effective on January 24, 2003. "Land Disposal Restrictions; CFR Correction" January 29, 2003 (68 FR 4392) EPA finalized corrections to the table in 40 CFR Section 268.44 by revising footnote 8. CERCLA "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" January 13, 2003 (68 FR 1537) EPA announced the deletion of the Wildcat Landfill Superfund Site from the National Priorities List (NPL). This deletion will be effective March 14, 2003, unless EPA receives adverse comment by February 12, 2003. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" January 16, 2003 (68 FR 2247) EPA announced the deletion of the ATSF Clovis Superfund Site from the NPL. This deletion will be effective March 17, 2003, unless EPA receives adverse comment by February 18, 2003. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" January 21, 2003 (68 FR 2699) EPA announced the deletion of the Western Tier Parcel of the Rocky Mountain Arsenal Superfund Site from the NPL. This partial deletion pertains only to the Western Tier Parcel of the site and does not include the other portions of the site, which will remain on the NPL. "Clarification to Interim Standards and Practices for All Appropriate Inquiry Under CERCLA and Notice of Future Rulemaking Action" January 24, 2003 (68 FR 3430) EPA published a direct final rule clarifying the interim standard set by Congress in the Small Business Liability Relief and Brownfields Revitalization Act for conducting "all appropriate inquiry" to establish that a landowner had no reason to know of contamination at a property under CERCLA liability provisions prior to purchasing the property. This rule is effective on March 25, 2003, without further notice, unless EPA receives adverse comment by February 24, 2003. OIL PROGRAM "Oil Pollution Prevention and Response; Non-Transportation- Related Onshore and Offshore Facilities; Final Rule and Proposed Rule" January 9, 2003 (68 FR 1348) EPA extended for a period of 60 days the dates for a facility to amend its Spill Prevention, Control, and Countermeasure (SPCC) Plan and implement the amended Plan, or in the case of facilities becoming operational after August 16, 2002, prepare and implement a Plan that complies with the newly amended requirements. "Oil Pollution Prevention; CFR Correction" January 29, 2003 (68 FR 4385) EPA finalized corrections to Appendix F to 40 CFR Part 112. PROPOSED RULES RCRA "Reopening of Comment Period for Proposed Exclusion for Identifying and Listing Hazardous Waste and a Determination of Equivalent Treatment" January 6, 2003 (68 FR 531) EPA reopened the public comment period for a previous proposal to approve two petitions submitted by the University of California-E.O. Lawrence Berkeley National Laboratory. This proposed decision was initially announced in the July 31, 2002 Federal Register (67 FR 49649). Comments must be received by February 6, 2003. "Waste Management System; Testing and Monitoring Activities; Reopening of Comment Period for the Proposed Methods Innovation Rule" January 16, 2003 (68 FR 2276) EPA extended the comment period by 60 days for its proposed rule entitled "Methods Innovation Rule (MIR) and Notice of Data Availability" that announced the availability of the new RCRA Waste Sampling Draft Technical Guidance (67 FR 66251; October 30, 2002). Written comments on the proposed MIR or RCRA Waste Sampling Draft Technical Guidance must be submitted on or before February 28, 2003. UST "Pennsylvania Approval of Underground Storage Tank Program" January 3, 2003 (68 FR 329) The Commonwealth of Pennsylvania has applied for approval of its underground storage tank (UST) program under Subtitle I of RCRA. EPA has reviewed Pennsylvania's application and has made the tentative determination that its UST program satisfies all of the requirements necessary to qualify for approval. A public hearing will be held on February 19, 2003, to solicit comments on the application, unless insufficient public interest is expressed by February 13, 2003. CERCLA "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" January 13, 2003 (68 FR 1580) EPA announced its intent to delete the Wildcat Landfill Superfund Site from the NPL and requested public comment on this action. EPA proposed this action as a direct final rule in the final rules section (68 FR 1537; January 13, 2003). Unless adverse comments are received by February 12, 2003, the deletion will become effective March 14, 2003. "National Oil and Hazardous Substance Pollution Contingency Plan; National Priorities List" January 16, 2003 (68 FR 2277) EPA announced its intent to delete the ATSF Clovis Superfund Site from the NPL and requested public comment on this action. EPA proposed this action as a direct final rule in the final rules section (68 FR 2247; January 16, 2003). Unless adverse comments are received by February 18, 2003, the deletion will become effective March 17, 2003. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" January 21, 2003 (68 FR 2726) EPA announced its intent to delete soil in the Impregnation Kit Area of the Former Nansemond Ordnance Depot Superfund Site from the NPL and requested public comment on this action. The remaining parcels of the site will remain on the NPL. OIL PROGRAM "Oil Pollution Prevention and Response; Non-Transportation- Related Onshore and Offshore Facilities" January 9, 2003 (68 FR 1352) EPA proposed to extend, by one year, the dates for a facility to amend its SPCC Plan and implement the amended Plan or, in the case of facilities becoming operational after August 16, 2002, prepare and implement a Plan that complies with the newly amended requirements. "Advance Notice of Proposed Rulemaking on the Clean Water Act Regulatory Definition of `Waters of the United States'" January 15, 2003 ( 68 FR 1991) EPA and the U.S. Army Corps of Engineers issued an advance notice of proposed rulemaking in order to obtain early comment on issues associated with the scope of waters that are subject to the Clean Water Act, in light of the U.S. Supreme Court decision in Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers, 531 U.S. 159 (2001). A future rulemaking may affect the regulations in 40 CFR Parts 110 and 112. NOTICES RCRA "The Commonwealth of the Northern Mariana Islands; Full Program Adequacy Determination of State Municipal Solid Waste Landfill Permit Program" January 3, 2003 (68 FR 366) The Commonwealth of the Northern Mariana Islands (CNMI) has applied for a determination of adequacy under RCRA Section 4005(c)(1)(C), 42 U.S.C. 6945(c)(1)(C). EPA Region I has reviewed the CNMI's municipal solid waste landfill (MSWLF) permit program application and has made a final determination that all portions of its permit program application are adequate to ensure compliance with the revised MSWLF criteria. "Land Disposal Restrictions: Treatment Standards for Mercury- Bearing Hazardous Waste" January 29, 2003 (68 FR 4481) EPA announced the public availability of two studies conducted on the treatment of mercury wastes. The studies were initiated to help evaluate whether EPA could propose treatment and disposal alternatives to the current land disposal restrictions (LDR) treatment standard of mercury retorting. EPA is not requesting comments on the mercury-related issues in this notice of data availability. CERCLA "Federal Agency Hazardous Waste Compliance Docket" January 2, 2003 (68 FR 107) EPA published the 16th update of the Federal Agency Hazardous Waste Compliance Docket. This update contains 8 additions and 11 deletions since the previous update on July 2, 2002 (67 FR 44200), as well as numerous other corrections to the docket list. At this time, there are 2,228 federal facilities listed on the docket. "Federal Agency Hazardous Waste Compliance Docket" January 21, 2003 (68 FR 2817) EPA published corrections to the 16th Update of the Federal Agency Hazardous Waste Compliance Docket (68 FR 107; January 2, 2003). ALL PROGRAMS "Acquisition Regulation: Background Checks for Environmental Protection Agency Contractors Performing Services On Site" January 22, 2003 (68 FR 2988) EPA proposed to amend the EPA Acquisition Regulation to add a clause requiring contractors and subcontractors to perform background checks and make suitability determinations for contractor and subcontractor employees performing services on or within federally owned or leased space and facilities, commercial space primarily occupied by federal employees, and Superfund, Oil Pollution Act, and Stafford Act sites.
