Umatilla County Resident Sentenced to 10 Years in Federal Prison on Methamphetamine Charge
 

Toby Kenneth Heer, a resident of Pendleton, Oregon, pled guilty and was sentenced today for Possession with the Intent to Sell Methamphetamine

Portland, Ore. — Toby Kenneth Heer, 48, and a resident of Pendleton, Oregon, pled guilty and was sentenced by United States District Court Judge Robert E. Jones to 10 years in federal prison for possessing with the intent to sell 50 grams or more of actual methamphetamine  Heer’s prison sentence will be followed by a five-year term of supervised release.

On August 4, 2005, officers from the Blue Mountain Narcotics Team (BENT), assisted by the Oregon State Police and the Pendleton Police Department, executed two state search warrants on properties associated with the defendant, Toby Kenneth Heer.  During the warrants the police found over 80 grams of actual methamphetamine, along with $2,200 in cash, scales, drug records, and material used for packaging narcotics. 

“Toby Heer was no stranger to the state criminal justice system,” Ms. Immergut stated.  “Given his criminal history and the amount of methamphetamine that the police found, we felt it was incumbent on our office to prosecute Mr. Heer.  Our message to methamphetamine dealers is simple: dealing methamphetamine in Oregon comes with severe consequences.”

As part of the sentence, the defendant abandoned his interest in a Ruger .357 Magnum Revolver and a collection of ammunition that had been previously seized from him.  He also forfeited his interest in the $2,200 in cash that was seized and a 19 foot drag boat in which the methamphetamine was found.
