January 2002 EPA530-R-02-005a February 2002 EPA530-R-02-005b March 2002 EPA530-R-02-005c FREQUENTLY ASKED QUESTIONS Are treatment, storage, and disposal facilities (TSDFs) required to keep land disposal restrictions (LDR) notifications and certifications that they have received from generators? If so, how long are they required to keep them? TSDFs must maintain copies of LDR notifications and certifications in their operating record. The operating record must be kept at the facility until closure of the TSDF (40 CFR Sections 264/265.73(b)). Are universal waste handlers required to manage spent lead-acid batteries under Part 266, Subpart G, or under Part 273? Handlers may choose the management standards with which they will comply. That is, they may either manage their batteries under the standards provided in Subpart G of Part 266 for spent lead- acid batteries that are being reclaimed, or they may comply with the universal waste regulations in Part 273 (60 FR 25505; May 11, 1995). What are elementary neutralization units? Elementary neutralization units are tanks, tank systems, containers, transport vehicles, or vessels used for neutralizing wastes that are hazardous only because they exhibit the corrosivity characteristic or because they are listed solely for the characteristic of corrosivity (Section 260.10). A tank, tank system, container, transport vehicle, or vessel that meets the definition of an elementary neutralization unit is exempt from permitting requirements under RCRA Subtitle C (Sections 264.1(g)(6), 265.1(c)(10), and 270.1(c)(2)(v)). In addition, generators managing hazardous waste immediately upon generation in an on-site elementary neutralization unit are not required to count those wastes toward their monthly generator status (Section 261.5(c)(2)). For purposes of EPCRA Section 312 Tier II reporting, is gasoline stored in an underground storage tank (UST) at a marina eligible for the higher threshold of 75,000 gallons? Under EPCRA Sections 311/312, the higher minimum threshold of 75,000 gallons is for gasoline stored entirely underground at retail gas stations that were in compliance at all times during the preceding calendar year with all applicable UST requirements. The regulations specify that a retail gas station is a facility engaged in selling gasoline principally to the public, for motor vehicle use on land (Section 370.20(b)(2)). Gas stations in marinas that sell fuel for boats are not intended to be included in the definition of "retail gas station" (64 FR 7031; February 11, 1999). For purposes of determining applicability of the Spill Prevention Control and Countermeasures (SPCC) Plan requirements in Part 112, the total capacity of all tanks and containers must be considered toward the storage capacity thresholds. This is true whether the tank or container is filled with oil, a mixture of oil and other substances, or is empty and not permanently closed. How do you "permanently close" a tank or container? A tank or container will be considered "permanently closed" when it is closed in the following manner: 1) All liquid and sludge have been removed from each tank and connecting lines. Any waste products removed were disposed of in accordance with applicable state and federal requirements. 2) All connecting lines have been blanked off, and valves are closed and locked. Conspicuous signs are posted on the tanks warning that it is a permanently closed tank and that vapors above the lower explosive limit are not present (Introduction and Background to the Oil Pollution Prevention Regulation; August 30, 1994). How does EPA determine if a facility is "reasonably expected" to discharge oil into or upon the navigable waters of the United States or adjoining shorelines for purposes of Part 112? This determination is based solely upon a consideration of the geographical, locational aspects of the facility, such as proximity to navigable waters or adjoining shorelines, land contour, and drainage. It excludes consideration of manmade features such as dikes, equipment or other structures that may serve to restrain, hinder, contain, or otherwise prevent a discharge of oil from reaching navigable water (Section 112.1(d)(i)). Final Rules RCRA "Wisconsin: Final Authorization of State Hazardous Waste Management Program Revisions" March 1, 2002 (67 FR 9406) Wisconsin has applied for final authorization of changes to its hazardous waste program under RCRA Section 3006(b), 42 U.S.C. 6926(b). EPA has determined that these changes satisfy all requirements needed to qualify for final authorization and is authorizing the state's changes through this final rule. This final authorization will become effective April 30, 2002, unless EPA receives written adverse comment by April 1, 2002. "Hazardous Waste Management System; Definition of Solid Waste; Toxicity Characteristic" March 13, 2002 (67 FR 11251) This action addresses two vacaturs ordered by the District of Columbia Circuit in Association of Battery Recyclers v. EPA. First, it deletes regulatory language that classified mineral processing characteristic sludges and by-products being reclaimed as solid wastes under RCRA's hazardous waste management regulations. Second, this rule codifies the decision that the Toxicity Characteristic Leaching Procedure may not be used for determining whether manufactured gas plant waste is hazardous under RCRA. CERCLA "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List; Correction" March 14, 2002 (67 FR 11424) EPA published a document in the Federal Register on February 8, 2002 (67 FR 5955), announcing the deletion of the White Bridge Road property of the Asbestos Dump Superfund Site from the National Priorities List. The document contained an error regarding a reference to "Table 2" of Appendix B of 40 CFR Part 300. This document corrects the reference to read "Table 1". "National Oil and Hazardous Substance Pollution Contingency Plan; National Priorities List" March 19, 2002 (67 FR 12478) On November 28, 2001, EPA published a notice of intent to delete (66 FR 59393) and a direct final notice of deletion (66 FR 59363) for the Compass Industries Landfill Superfund Site from the National Priorities List. EPA is removing the direct final notice of deletion amendment due to adverse comments that were received during the public comment period and will restore the regulatory text that existed prior to the direct final notice of deletion. Proposed Rules RCRA "Wisconsin: Final Authorization of State Hazardous Waste Management Program Revisions" March 1, 2002 (67 FR 9427) EPA proposed to grant final authorization to the hazardous waste program revisions submitted by the State of Wisconsin. EPA authorized the state's program revisions as a direct final rule without prior proposal in the final rules section (67 FR 9406; March 1, 2002). The direct final rule provides a detailed rationale for authorization. Unless adverse comments are received by April 1, 2002, the direct final rule will become effective April 30, 2002. "Hazardous Waste Management System; Proposed Exclusions for Identifying and Listing Hazardous Waste" March 7, 2002 (67 FR 10341) EPA proposed to exclude wastewater treatment plant sludge from conversion coating on aluminum generated by 11 automobile assembly facilities in the State of Michigan from the lists of hazardous wastes. The Agency is proposing to use an expedited process to evaluate these wastes under a pilot project developed with the Michigan Department of Environmental Quality. Comments on this proposal will be accepted until April 22, 2002. "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Proposed Exclusion" March 15, 2002 (67 FR 11639) EPA proposed to grant a petition submitted by the U.S. Department of Energy Savannah River Operations Office (DOE-SR) to exclude certain hazardous wastes from the lists of hazardous wastes under RCRA. DOE-SR petitioned EPA to grant a one-time, generator-specific delisting for its F006 and F028 waste, because DOE-SR believes that its waste does not meet the criteria for which these types of wastes were listed. Comments on this proposal will be accepted until April 29, 2002. "Regulation of Hazardous Oil-Bearing Secondary Materials From the Petroleum Refining Industry and Other Hazardous Secondary Materials Processed in a Gasification System To Produce Synthesis Gas" March 25, 2002 (67 FR 13683) EPA proposed revisions to the RCRA hazardous waste program to allow a conditional exclusion from the definition of solid waste. This exclusion would be for hazardous oil-bearing secondary materials generated by the petroleum refinery industry when these materials are processed in a gasification system to produce synthesis gas fuel and other non-fuel chemical by-products. EPA also proposed a conditional exclusion for other hazardous secondary materials generated from other industrial sectors which are amenable to gasification. Comments must be received by June 24, 2002. UST "Nebraska: Tentative Approval of Nebraska Underground Storage Tank Program" March 7, 2002 (67 FR 10353) The State of Nebraska has applied for approval of its underground storage tank program under Subtitle I of RCRA. EPA has reviewed the Nebraska application and has made the tentative decision that Nebraska's underground storage tank program satisfies all of the requirements necessary to qualify for approval. The Nebraska application for approval is available for public review and comment.
