Physical construction can begin on a new hazardous waste management facility after the owner or operator of the facility has submitted Parts A and B of the permit application and received a final effective RCRA permit (40 CFR Section 270.10(f)). Physical construction is defined as excavation, movement of earth, erection of forms or structures, or similar activity to prepare a hazardous waste management facility to accept hazardous waste (Section 270.2). Can universal waste be shipped off site without a hazardous waste manifest? Universal waste regulations do not require small or large quantity handlers of universal waste to use a manifest for transportation off site. Small quantity handlers of universal waste are not required to keep records of their off-site shipments (Section 273.19). Large quantity handlers of universal waste must follow the tracking requirements in Section 273.39, which include keeping a record of each off-site shipment of universal waste from the handler to other facilities. The record may take the form of a log, invoice, manifest, bill of lading, or other shipping document. If an owner or operator must make a change to a RCRA permit that is not specified in Appendix I of 40 CFR Section 270.42, what class modification procedures should the permittee follow? In the case of permit modifications not explicitly listed in Appendix I of Section 270.42, the permittee may submit a Class 3 modification request or may request a determination that the modification be reviewed and approved by the implementing agency as a Class 1 or Class 2 modification (Section 270.42(d)). Who must be notified when a facility subject to EPCRA Section 304 releases a reportable quantity of any extremely hazardous substance or CERCLA hazardous substance? An owner or operator shall immediately notify the community emergency coordinator for the local emergency planning committee of any area likely to be affected by the release and the state emergency response commission of any state likely to be affected by the release (Section 355.40(b)(1)). For purposes of the Oil Pollution Prevention regulations, are liquid natural gas (LNG) and liquid petroleum gas (LPG) considered oils? LNG and LPG are not considered oils. Highly volatile liquids that volatilize on contact with air or water do not meet the definition of oil in Section 112.2 (67 FR 47042; 47076; July 17, 2002). Does asphaltic cement meet the definition of oil for purposes of the Oil Pollution Prevention regulations? Asphaltic cement meets the definition of oil in Section 112.2 and is subject to the Oil Pollution Prevention regulations because it is a petroleum-based product that exhibits oil-like characteristics (67 FR 47042, 47076; July 17, 2002). CALL CENTER QUESTOINS AND ANSWERS RCRA 1. Applicability of Hazardous Waste Identification Rule (HWIR) to As-Generated Wastes A facility generates spent carbon from the treatment of wastewater containing explosives (K045). K045 waste is listed solely for the characteristic of reactivity in 40 CFR Section 261.32; however, this particular waste does not exhibit any characteristic of hazardous waste at the point of generation. Is the as-generated waste still considered a RCRA hazardous waste since it meets the listing description of K045? If so, would this waste be subject to the land disposal restrictions (LDR) requirements in Part 268? The as-generated waste would not be considered a hazardous waste even though it meets the listing description for K045. A waste listed solely for the characteristic of ignitability, reactivity, and/or corrosivity is excluded from regulation as a hazardous waste once it no longer exhibits a characteristic of hazardous waste (Section 261.3(g)(1)). The same rationale applies when a waste meets such a listing description, but does not exhibit a characteristic of hazardous waste at the point of generation. In the Hazardous Waste Identification Rule, EPA stated that extending this exclusion to as-generated wastes that do not exhibit a characteristic of hazardous waste remains protective of human health and the environment (66 FR 27266, 27283; May 16, 2001). Additionally, the as-generated waste would not be subject to the LDR requirements in Part 268 (51 FR 40572, 40620; November 7, 1986). EPA has clarified that when a waste has been listed solely because it exhibits a characteristic of ignitability, corrosivity and/or reactivity and that waste does not exhibit any hazardous waste characteristic at the point of generation, then that waste is not subject to the LDR requirements (66 FR 27266, 27269; May 16, 2001). If, however, the waste exhibits a characteristic at the point of generation and subsequently becomes decharacterized, then it would be subject to the LDR requirements (Section 261.3(g)(3)). CERCLA 2. Maintenance of the Administrative Record Under CERCLA Section 113(k), EPA must establish and maintain an administrative record for each Superfund site. Where and for how long does the administrative record need to be maintained? Generally, two copies of the administrative record should be maintained for each Superfund site, a federal master copy and a local copy accessible to the public. If the site is Fund- financed or PRP-led, EPA usually maintains the master copy of the record file at the regional office or another central location. If a state or other federal agency is the lead agency at a site, EPA normally ensures that the state or federal agency maintains the master copy. These master record files are permanent records and, at this time, are being retained indefinitely. However, neither the statute nor the regulations addresses how long an administrative record must be made available to the public at a local repository. Currently, the Agency's policy is that the record should remain available as long as there is possible or ongoing litigation and as long as there is considerable public interest in the record. In addition, there are general recordkeeping requirements applicable to federal records that should be consulted to ensure records are kept for an appropriate period of time. FINAL RULES RCRA "Land Disposal Restrictions: National Treatment Variance To Designate New Treatment Subcategories for Radioactively Contaminated Cadmium-, Mercury- and Silver-Containing Batteries" October 7, 2002 (67 FR 62618) EPA granted a national treatability variance from the land disposal restrictions (LDR) treatment standards for radioactively contaminated cadmium-, mercury-, and silver-containing batteries by designating new treatment subcategories for these wastes in response to a rulemaking petition from the Department of Energy. This rule is effective on November 21, 2002, without further notice, unless EPA receives adverse comment by November 6, 2002. "Municipal Solid Waste Landfill Location Restrictions for Airport Safety" October 8, 2002 (67 FR 62647) EPA withdrew the direct final rule for Municipal Solid Waste Landfill Location Restrictions for Airport Safety published in the July 11, 2002 Federal Register (67 FR 45915) due to the receipt of adverse comment. "Massachusetts: Extension of Interim Authorization of State Hazardous Waste Management Program Revision" October 31, 2002 (67 FR 66338) EPA issued a direct final rule to extend the expiration date for the interim authorization of the Massachusetts program for regulating cathode ray tubes (CRTs) from January 1, 2003, to January 1, 2006. This extension of interim authorization will become effective on December 30, 2002, and remain in effect until January 1, 2006, unless EPA receives adverse written comment by December 2, 2002. CERCLA "National Oil and Hazardous Substance Pollution Contingency Plan; National Priorities List" October 2, 2002 (67 FR 61802) EPA published a direct final notice of deletion of Parcel 4 of the Department of Energy Mound Superfund Site from the National Priorities List (NPL). This direct final notice of partial deletion will be effective December 2, 2002, unless EPA receives adverse comments by October 31, 2002. "National Priorities List for Uncontrolled Hazardous Waste Sites" October 24, 2002 (67 FR 65315) This rule added the Libby Asbestos Site to the General Superfund Section of the NPL. The effective date for this amendment is November 25, 2002. PROPOSED RULES RCRA "Land Disposal Restrictions: National Treatment Variance to Designate New Treatment Subcategories for Radioactively Contaminated Cadmium-, Mercury-, and Silver-Containing Batteries" October 7, 2002 (67 FR 62626) EPA proposed to grant a national treatability variance from the LDR treatment standards for radioactively contaminated cadmium-, mercury-, and silver-containing batteries by designating new treatment subcategories for these wastes in response to a rulemaking petition from the Department of Energy. EPA proposed this action as a direct final rule in the final rules section (67 FR 62618; October 7, 2002). "Ohio: Proposed Authorization of State Hazardous Waste Management Program Revision" October 21, 2002 (67 FR 64594) Ohio has applied to EPA for final authorization of certain changes to its hazardous waste program under RCRA. EPA has reviewed Ohio's application, has determined that these changes satisfy all requirements needed to qualify for final authorization, and is proposing to authorize the state's changes. Written comments must be received on or before December 5, 2002. "Waste Management System; Testing and Monitoring Activities; Proposed Rule: Methods Innovation Rule" October 30, 2002 (67 FR 66252) EPA proposed to amend a variety of testing and monitoring requirements throughout the RCRA regulations. In addition, the Agency announced the availability of a new guidance document for public comment entitled RCRA Waste Sampling Draft Technical Guidance. Written comments must be received on or before December 30, 2002. "Massachusetts: Extension of Interim Authorization of State Hazardous Waste Management Program Revision" October 31, 2002 (67 FR 66351) EPA proposed to extend the expiration date for the interim authorization of the Massachusetts program for regulating CRTs from January 1, 2003, to January 1, 2006. EPA proposed this action as a direct final rule in the final rules section (67 FR 66338; October 31, 2002). Unless adverse comments are received by December 2, 2002, the direct final rule will become effective on December 30, 2002. CERCLA "National Oil and Hazardous Substance Pollution Contingency Plan; National Priorities List" October 2, 2002 (67 FR 61844) EPA announced its intent to delete Parcel 4 of the Department of Energy Mound Superfund Site from the NPL and requested public comment on this proposed action. EPA proposed this action as a direct final notice in the final rules section (67 FR 61802; October 2, 2002). Unless adverse comments are received by October 31, 2002, the deletion will become effective December 2, 2002. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" October 22, 2002 (67 FR 64846) EPA announced its intent to delete six areas of the West Virginia Ordnance Works Superfund Site from the NPL and requested public comment on this proposed action. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" October 23, 2002 (67 FR 65082) EPA announced its intent to delete the western tier parcel of the Rocky Mountain Arsenal Superfund Site On-Post Operable Unit from the NPL on September 23, 2002 (67 FR 59487). The 30-day public comment period was scheduled to end on October 23, 2002. During the public meeting held on October 10, 2002, a formal request was made to extend the public comment period. In response, EPA has extended the public comment period for an additional 30 days, until November 22, 2002, through this notice. EPCRA "Overburden Exemption; Toxic Chemical Release Reporting; Community Right-to-Know; Administrative Procedure Act" October 10, 2002 (67 FR 63060) EPA announced that it is denying an Administrative Procedure Act petition to modify its definition of "overburden" to include both consolidated and unconsolidated material. Specifically, EPA denied this petition because EPA's review of the petition and available information resulted in the conclusion that consolidated rock includes materials that often contain toxic chemicals above negligible amounts, often in significant quantities. "Proposed Agency Information Collection Activities: Continuing Collection; Comment Request; Information Collection Request for MACT Reporting and Recordkeeping Requirements for the Hazardous Waste Combustors" October 30, 2002 (67 FR 66144) EPA announced that the ICR entitled "Information Collection Request for MACT Reporting and Recordkeeping Requirements for the Hazardous Waste Combustors," EPA ICR Number 1773.06, OMB Control Number 2050-0171, has been forwarded to OMB for review and approval. The current expiration date for this ICR is February 28, 2003. Comments must be submitted on or before December 30, 2002. CERCLA "Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) or Superfund, Section 104 (k); `Announcement of Proposal Deadlines for the Competition for the 2003 National Brownfields Assessment, Revolving Loan Fund, and Cleanup Grants'" October 24, 2002 (67 FR 65348) EPA announced that it will begin to accept proposals for the National Brownfields Assessment, Revolving Loan Fund, and Cleanup Grants on October 24, 2002. This notice provided information on how to obtain the application guidelines. These grants may be used to address sites contaminated by petroleum and hazardous substances, pollutants, or contaminants (including hazardous substances co-mingled with petroleum). The application deadline for initial proposals is December 16, 2002. "Memorandum of Understanding Between the U.S. Environmental Protection Agency and the U.S. Nuclear Regulatory Commission; Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites" October 24, 2002 (67 FR 65375) The Nuclear Regulatory Commission (NRC) announced that it signed a Memorandum of Understanding (MOU) with EPA on the radiological decommissioning and decontamination of NRC-licensed sites. The MOU signed by NRC and EPA provides that EPA will defer exercise of authority under CERCLA for the majority of facilities decommissioned under NRC authority. The MOU includes provisions for NRC and EPA consultation for certain sites when, at the time of license termination, (1) groundwater contamination exceeds EPA- permitted levels; (2) NRC contemplates restricted release or alternate criteria for release of the site; and/or (3) residual radioactive soil concentrations exceed levels defined in the MOU. EPCRA "Forum on State and Tribal Toxics Action; Notice of Public Meeting" October 10, 2002 (67 FR 63088) EPA announced the fall meeting of the Forum on State and Tribal Toxics Action (FOSTTA) to collaborate on environmental protection and chemical and prevention issues. This notice announced the location and times of the meetings for the Chemical Information and Management, Pollution Prevention, Toxics Release Inventory, Tribal Affairs Projects, and components of FOSTTA. Tentative agenda topics are also outlined in this notice. "Toxic Chemical Release Reporting; Community Right-To-Know; Notice of On-Line Dialogue" October 15, 2002 (67 FR 63656) EPA announced it will hold an online public dialogue for 60 days from October 16, 2002, to December 17, 2002, as part of a national Stakeholder Dialogue on the Toxics Release Inventory (TRI) Program that EPA is launching. EPA is seeking suggestions and ideas on the Agency's methods for reporting, collecting, processing, and releasing the TRI data. EPA also announced the availability of three issue papers, which are intended to provide background to help focus the online dialogue. "Toxic Chemical Release Reporting; Community Right-to-Know; Request for Comment on Change of Contractor Handling Trade Secret Claims" October 25, 2002 (67 FR 65566) This notice announced an upcoming change in location and contractor designated to manage the TRI data processing for all TRI submissions including TRI trade secret and confidential information submitted pursuant to 40 CFR Part 350. Once the transition to the new location has been completed, information regarding the new mailing address will be posted on the TRI Web site (www.epa.gov/tri) and will be included in the 2002 Toxic Chemical Release Inventory Reporting Forms and Instructions.
