Immigration Visa...

USCIS is in shambles right now. Applicants in some category for Adjustment of Status (AOS) have been waiting for over two years now for an approval. The Obama administration should seriously consider taking Immigration out of Homeland Security for those applicants that are here legally and have filed all the necessary and required paperwork in order to streamline the process and reduce the approval time to six to nine months instead of the current 16 to who knows how long months. And let Homeland Security deal with the illegal immigration issue for obvious reasons. And special emphasis should be paid toward applicants who are here legally with their families and have filed their application for AOS.

Congress also need to immediately increase the cap for H-1B and other very important immigrant worker who will be an asset to the United States. The current amount of Visa available is less than 90,000. Back in 2002 and 2003 it was set to over 200,000.

Isn't it time that Immigration laws be about what works instead of what makes a great speech?

No, these are people who have the right to be permanent residents, hence green-card holders.

It is true and a good point. Keep Legal Immigraiton separate from Illegal Imm and Border crossings, port of entry problems, etc

Some LEGAL immigrants are here as managers of foreign companies and actually CREATE jobs for US citizens upon entry with a mgr visa.

The task has ALWAYS been to uphold ALL existing immigration laws re entry of foreigners and has never been done, tho Bush promised this after 9/11.

The millions out of work was not cause by the shortage of work visa. Matter of fact increasing the number of work visa for well educated and well qualified people will probably create jobs in this country. Not only because more people will have to be hired to process them, but most many of the well educated immigrant have proven more often to be very business oriented. The millions out of work is cause by those who were too blind to see that the man they put in charge of running the country for the last eight years was not the brightest of the bunch, and who fell asleep at the switch in everything he did. Immigration, Terrorism, The Economy, Environment and so on...

I have a friend from China who is doing important research on leukemia at Washington University in St. Louis.  He is married to a girl from China who is a Phd candidate at the prestigious George Warren Brown School of Social Work at Washington University.  He has been denied his 10 year green card.  He is educated, doing unique and valuable research, contributing to the tax base and he can't continue his research.  That is crazy.  He is not taking any American's job. She also has done extremely well and would be a benefit to this country.

I suggest that our educational system is not strong enough in the sciences to produce any competitors for him.  And she is rapidly progressing toward her Phd.   My daughter's fiancee is a biology phd candidate at Columbia University, he says it is not unusual at all for our system to make it hard for intelligent, educated foreign scientists --many who were educated in this country and therefore we as citizens contributed to their education --not to be able to stay and do research.  As a child growing up in the 50's I remember being proud of "the brain drain" from the rest of the world.  We are hurting our culture and the world by not making it easy for these people to stay.

Our harsh immigration policies have turned the Statue of Liberty into a liar.   The poem engraved on her base says,

"Give me your tired, your poor,

Your huddled masses yearning to breathe free,

The wretched refuse of your teeming shore.

Send these, the homeless, tempest-tost to me,

I lift my lamp beside the golden door!"

I think its time we restored the truthfulness of the Statue of Liberty.    The reason we became such a great country was because we opened our doors to those who dreamed of a better life.  Closing the doors against those dreamers makes America less great.   The freshness and vitality of the immigrant spirit created this country.   We're all immigrants here except for the Native Americans.   Our current immigration policies are xenophobic.  We need to let go of that fear.  People are people no matter where they come from.   We cannot claim to be the land of freedom and opportunity while locking our doors.    Everyone deserves the chance to live in a land where people are equal and free.

I have been waiting for more than 6 year for my Green Card and I am here since 98 legally.
All my friends who applied in 200-2001 are already citizens whereas I am still waiting sice 2002.

This is price we pay for being law aiding , tax paying highly qualified legal immigant.

USCIS is shame to the US . It's the most discriminating , unorganized, arrogant organisation which run on immigrant paid fees but works against them.

They make sure that legal immigrants just keep waiting for their Green Card .
Bad Employers exploit this very situation of these employees by paying them low wages , no benifites as the employee can't change his job without jeopadicing their Green card.

USCIS is mordern version of slave trading promoter/broker of this era.

Are you out of your mind?????    THERE SHOULD BE NO MORE VISAS GRANTED FOR FOREIGNERS TO COME OVER TO AMERICA TO WORK!!!!

Americans are being denied jobs because someone from U.K., India, China, Korea or other country is over here on a work visa (green card).       The Federal government must stop issuing all visas NOW!      Americans need jobs in America.   Let foreigners go home and find their own jobs!

Ditto for letting foreigners come over here and crowd our universities and medical schools.

IN SHORT, CLOSE THE DOOR TO ALL IMMIGRATION AND ESPECIALLY TO THOSE WHO WANT TO COME HERE TO WORK.

WE ARE OVERCROWDED NOW - OUR SCHOOLS CAN'T TAKE ANY MORE, OUR HEALTH SYSTEM CAN'T CARE FOR THESE PEOPLE AND AMERICANS ARE FED UP WITH FOREIGNERS LIVING AND WORKING IN OUR COUNTRY.   THEY DON'T APPLY FOR CITIZENSHIP SO THEY DON'T HAVE TO SERVE IN THE MILITARY.

Dear President Elect.
I have a business and a house. I have just had my application for my E2 visa to be extended for another 2 years. and because it was late. they have denied my application. but they still cashed the checks.
I have a hair salon and I have employees. does this petty appproach to my problem, really mean that I will have to fire all my staff. because the application was a few days late due mainly due to the large amount of mail being processed just before christmas.I am employing americans.and this decision could affect more people than just me, At a time when the economy is so bad. it is not irispsonsible for one immigration official to put my staff out of work. I need help getting this decision reversed. I am one of the good guys.
I need someones help.

AmericaFirst - you are not living in the America of today.  You are trapped in the America of the past.  Scream all you want, you cannot stop the wheels of change from turning.  Our President elect is the epitomy of that change.  If you do not want you job taken by legal immigrants, then get a better education to make yourself more competitive in the employment world. Otherwise, take the jobs from the illegal immigrants.

I have been in this country legally for 9 yrs, came for graduate studies. I don't have permanent residency yet but I know people who came 2 yrs ago directly to US through consulting companies and they got their permanent residency by abusing the system.

I would recommend to grant green cards immidiately to aliens who graudated in the US
The idea is easy to implement, all you need is get the scanned copy of the degree, do name checks, security checks etc which is good.

Legal Immigration process should defintely be improved. For applicants who have Masters from US universities should be exempt from the 140,000 annual employment based green card quota.

I also recommend abolishing the per country cap that is currently in place for countries like India, China, Mexico, Phillipines. My employer applied for employment based green card for me (Indian Citizen) and my colleague (UK Citizen) he got his green card last week, and I don't think I will get mine atleast till next 6 to 7 years. Its not quota, its discrimination against applicants from some countries.

Look at Canada, I applied for canadian permanent residence as a back up to US permanent resident. I have my permanent resident card in my hand in 11 months. I think if United states does not fix the legal immigration process, immigrants "highly skilled" will be diverted to other countries where the process is smoother.

If the HB1 and other visa programs (more than 23) are a provision of NAFTA, it needs to be revised. More than 350,000 visas were issued in 2007. Corportations such as Microsoft keep crying for more HB1 visas because they claim that they cannot find technicians and scientists to fill the positions. These jobs are never offered to Americans. Many of our people are walking the streets looking for these jobs that are given to HB1 visa holders because they work for lower wages. And they do not go home. They stay here holding the lower paying jobs that are never offered to Americans. Companies have been found to be giving each other help in how to avoid hiring Americans. It is all a matter of the profit margin with no consideration for the welfare of American workers. A scientist with a PH. D now earns from $35,000 to $40,000 a year. What incentive is that for our youth to become a scientist with a PH.D.?  The visa program has lowered the standard of living for the American workers. If the corporations can't find technical and scientific workers, what is wrong with persuading them to help with the education and training of young people to fit their needs? Perhaps there could be some tax incentive program to encourage this. In summary, NAFTA might have some good effects, but the effect of lowering our standard of living in the USA should no longer be tolerated. I hope that Obama will follow through with his campaign promises to revise NAFTA.  MerryMary

Clearly we need a legal immigration system where the supply of legal immigration more closely matches the demand for legal immigration from our economy, families, and changing demographics (older, more educated, but still creating jobs that require little training).

I think we need to combine that system with a plan to get those who are currently here illegally and outside the system legal and into the system.  We weed out the criminals and the folks working and raising families here do so under the same rules, responsibilities, and rights as every one else.

MerryMary, small correction. Almost 90% of H1B jobs related to IT/engineering pay over 70K for those with just a Bachelor's degree. I would image s/he with a PhD should be earning a lot more. The employer is required to pay the market wage per H1B regulations.

Its not about more visas that lets more people come to this country but to provide opportunities to people who are already here in the workforce and have contributed as much as 5 to 10 years working here.

Please fix legal immigration..

I have been here legally for six years and am waiting for my greencard for 5 years, stuck in bureaucratic delays of USCIS. My life is on HOLD. I cant vote, cant participate in the political process, cant invest in buying a home worryfree and cant have my voice heard.. I am paying US taxes, abiding by the US laws and am adding value to US Economy. It is very frustrating to note that USCIS wasted 218,000 greencard visa numbers while hard working people like me are waiting in the line.

Quoting from CIS Ombudsman report to Congress in 2007

"For example, when employment-based visas are not used during the year they are authorized, they are lost and are not available for future use without special legislation. In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards.36 Based on USCIS use of visa numbers as of May 2007, at present consumption rates approximately 40,000 visas will be lost in FY 07 without a dramatic increase in USCIS requests of visa numbers.37 As illustrated below, since 1994 there have been over 218,000 un-recaptured employment-based visas lost due to underutilization of the employment-based visas."

I'd like to VOTE, have some certainty in my life plans so that I can invest and buy a home without worrying about the fate of my long outstanding application. Please recapture all the numbers that have been lost due to  bureaucratic delays. PLEASE FIX THE PROCESS and recapture wasted visa numbers..

I am an Immigration Delay Victim.

I have been waiting for 9 years for my green card, I came here legally, worked here legally, paid taxes legally and still after 9 years I haven't recieved my green card yet. It's stuck on USCIS with the 2007 visa bulletin and associated issues.

Google for "Visa Bulletin", "Priority Dates", "Processing Dates".. With all these dates , our family cannot make any future plans. Hudreds of thousands of people like me here legally and still in a limbo state on their green card. We are working hard and paying taxes. I think the immigration committe should take this delay in serious consideration.

Please Mr. President Elect OBAMA, Please have the immigration subcommitte take a serious look on this big issue.

I think that whole process of Green Card application should be simplified for people who are here working on H-1B visa status. These people should be given rights to apply  for permanent residency on their own behalf, at least after living in the US for a certain period of time, let's say 5 years.

This is unbelievable. Millions of Americans are out of work and you want to increase the amount of immigration visas being issued?

How many Americans actually voted for this? Zero. The people voting this up are foreigners, period.
