Solicitor Borough of Lavallette 191 West Whitehorse Pike Berlin, New Jersey 08009 RE: Complaint number Dear Ms. Bisset: This letter officially resolves the complaint that was filed with the Civil Rights Division of the Department of Justice, alleging violations of title II of the Americans with Disabilities Act of 1990 (title II), by the Borough of Lavallette, New Jersey (Borough). Title II prohibits discrimination against qualified individuals with disabilities by state and local governments based on disability. The complainant specifically alleges that the Borough Council held a public meeting on August 25, 1995, in a space that was not accessible to individuals with mobility impairments. The Borough provided the Department of Justice a letter declaring that all future public meetings will be held in locations that are accessible to individuals with mobility impairments, and that notices of public meetings will be posted in an accessible location. The letter further declares that the Borough will add a provision to the notices of public meetings indicating that the meetings are being held in locations that are accessible to individuals with mobility impairments, until the completion of modifications that will bring Borough Hall into compliance with title II. Because the Borough has taken appropriate actions to comply with the requirements of title II, we have closed our files with regard to this complaint.
