Applicability of the Subpart CC LDR Exemption to Soils The provisions in 40 CFR Parts 264/265, Subpart CC provide an exemption from Subpart CC controls for tanks, surface impoundments, and containers managing hazardous wastes that meet the land disposal restrictions (LDR) standard for volatile organic compounds (VOCs) (Sections 264.1082(c)(4) and 265.1083(c)(4)). The LDR exemption applies only when VOC concentrations in the waste meet the numerical concentration limits in Section 268.40 or when the waste has been treated by the treatment technology established for the waste in Section 268.42(a). For example, Subpart CC controls are not required for tanks, surface impoundments, or containers storing D018 nonwastewaters that contain benzene at a concentration below 10 mg/kg and meet the universal treatment standards (UTS) for VOCs. If an owner or operator treats D018 soil that is regulated under Subpart CC to meet the alternative soil treatment standards in Section 268.49, can this soil be managed in units that do not have Subpart CC controls? Tanks, containers, and surface impoundments storing soils that contain hazardous waste and that meet the alternative soil treatment standards in Section 268.49 for organic constituents are subject to the Subpart CC air emissions standards. Units storing hazardous soils are eligible for the LDR exemption from Subpart CC only when the VOCs meet the numerical concentrations specified in Section 268.40 or when the soil has been treated by a treatment technology established in Section 268.42(a) for the organic hazardous constituents in the soil. Wastes treated to a standard, such as the alternative soil treatment standards, which does not fully remove VOCs to the extent contemplated in creating the Subpart CC exemption remain subject to Subpart CC rules (62 FR 64636, 64645; December 8, 1997). Although the LDR exemption would not apply in this case, these soils may qualify for other exemptions from Subpart CC controls, such as the remediation waste exemption in Sections 264/265.1080(b)(5). 2. Immobilized Debris and Subtitle D Landfills Under the land disposal restrictions (LDR) in 40 CFR Part 268, hazardous debris must either be treated to meet the LDR treatment standard for the listed or characteristic waste which contaminates it, or be treated by a specific technology appropriate for the debris and contaminant type (57 FR 37221; August 18, 1992). The latter includes a variety of extraction, destruction, and immobilization technologies described in Table 1 of Section 268.45. Hazardous debris which is treated by an extraction or destruction technology and is no longer characteristic can be sent to a Subtitle D landfill (Section 268.45(c)). Can debris which exhibits a characteristic of hazardous waste, and is then treated using an immobilization technology, also be sent to a Subtitle D landfill? Immobilized hazardous debris which still exhibits characteristics cannot be sent to a Subtitle D landfill. Characteristic debris that has been treated using an immobilization technology and no longer exhibits a characteristic of hazardous waste may be disposed in a nonhazardous waste landfill (Memo, Shapiro to Deitchman; June 23, 1994). On the other hand, debris contaminated with a listed hazardous waste and treated using an immobilization technology must always be managed in a Subtitle C landfill unless the owner and operator gets a site-specific determination from the EPA Regional Administrator (Section 268.45(c)). 3. Post-Closure Permit Renewals Owners and operators of land-based units receiving waste after July 26, 1982, or certifying closure according to 40 CFR Section 265.115 after January 26, 1983, must obtain a post-closure permit, unless they demonstrate closure by removal or decontamination as provided under Section 270.1(c)(5) and (6) or obtain an enforceable document in lieu of a post-closure permit under Section 270.1(c )(7) (Section 270.1(c)). RCRA permits have a fixed term not to exceed 10 years (Section 270.50(a)). However, the post-closure care period lasts for 30 years after completion of closure, unless the Regional Administrator shortens or extends the post-closure care period in accordance with Sections 264/265.117(a)(2) (Sections 264/265.117(a)(1)). Must owners and operators renew post-closure permits during the post- closure care period? Owners and operators of land-based units that receive post- closure permits must renew their permits every 10 years during the post-closure care period. Section 3005(c)(3) of RCRA requires that all permits shall be for a fixed term, not to exceed 10 years. Congress enacted this provision to ensure that facilities are periodically reviewed and requirements for them are updated to reflect the current state of the art (50 FR 28702, 28722; July 15, 1985). The term of a RCRA permit cannot be extended by modification beyond 10 years, except for the continuation of an expiring permit as provided under Section 270.51 (Section 270.50(b)). The owner and operator needs to submit only the information specified in Section 270.28 for the post-closure permit renewal, unless the permitting agency requires additional information.
