SWBT claims that the petition is necessitated by the Texas Telecommunication Law, which, SWBT states, allows local exchange competition by permitting cerificated carriers to resell SWBT's tariffed local exchange services. SWBT asserts that grant of the requested waivers satisfies the "good cause" standard set forth in 1.3 of the Commission's Rules and will serve the public interest. SWBT claims that it will not have a direct relationship with end user customers of resellers, and therefore requests waiver of the Part 69 Rules in order to allow it to bill End User Common Line (EUCL) and Presubscription Change (PIC) charges directly to resellers. According to SWBT, without the waivers, it would not be able to recover from resellers (to the extent that resellers have direct relationships with end user customers with whom SWBT will no longer have direct relationships) either EUCL charges or costs incurred by PIC requests. SWBT states that the Texas Telecommunication Law becomes effective September 1, 1995 and competitors could apply for and conceivably receive certification as early as September 1, 1995. SWBT, therefore, asks that the Commission grant the requested waivers expeditiously. Interested parties should file comments on Southwestern Bell Telephone Company's petition by September 6, 1995 and reply comments by September 13, 1995 with the Secretary, FCC, 1919 M Street, N.W., Washington, D.C. 20554.
