These implementation guides were developed by the Office of Environment, Safety and Health (EH) to assist those who must comply with the requirements of 10 CFR 835. On December 23, 1996, a proposed amendment to 10 CFR 835 was published in the Federal Register for a 60 day public review. For consistency with the proposed changes to 10 CFR 835, the implementation guides originally issued by EH were revised and one new implementation guide was developed. Eleven of the implementation guides are ready for formal coordination. Two more implementation guides will be made available in several weeks. Attachment 1 lists the correspondence between the old and new document numbers. These implementation guides provide acceptable approaches for implementing and operating specific parts of the overall radiation protection program for DOE activities involving ionizing radiation. The implementation guides do not establish any new requirements. Instead, they identify the requirements of 10 CFR 835 that relate to a specific major topical area and provide guidance on the characteristics of a radiation protection program the DOE staff considers acceptable means of complying with the regulatory requirements. Please review the attached incoming memorandum from the Office of Environment, Safety and Health for additional information about the implementation guides. Comments that focus on the provisions of the rule as opposed to acceptable implementation approaches must be submitted in accordance with the instructions in the explanatory material at the beginning of the proposed amendment. Comments on the draft directives are due by June 30, 1997. MAJOR ISSUES and SUGGESTED COMMENTS should be designated as such when submitted. MAJOR ISSUES shall be limited to instances where a directive in its entirety, or its requirements, would have an adverse effect on Departmental policy objectives, mission accomplishment, economy, efficiency, or other management concerns that would preclude its publication. Nine implementation guides are ready for formal coordination. Four more implementation guides will be made available in several weeks. These implementation guides provide acceptable approaches for implementing and operating specific parts of the overall radiation protection program for DOE activities involving ionizing radiation. The draft implementation guides do not establish any new requirements. Instead, they identify the requirements of 10 CFR 835, as modified by the proposed amendment, that relate to specific major topical areas and provide guidance on the characteristics of a radiation protection program the DOE staff considers as an acceptable means of complying with the regulatory requirements as proposed. Our intention in issuing these revised guides for review and comment while the proposed amendment is available for public review is (1) to provide perspective on the proposed amendment; thereby, enhancing stakeholders the ability to comment on the amendment, and (2) to ensure that a final set of implementation guides are available within several months after the revised 10 CFR 835 is issued as a final rule. Because the draft implementation guides and proposed rule will are available for review and comment at the same time, we have the following information to assist in the review of the draft guides. o The provisions in these implementation guides do not pre-suppose the Department's final position on related portions of the proposed amemdment to 10 CFR 835. Rather, they indicate our current views regarding acceptable approaches to implementing the proposed provisions of 10 CFR 835. o Comments that focus on the provisions of the rule as opposed to acceptable implementation approaches must be submitted in accordance with the instructions in the explanatory material at the beginning of the proposed amendment. Comments on the proposed implementation approaches are to be submitted according to the instructions provided by the directive system. o The comment period for the draft implementation guides will be 120 days. Thus, it will extend approximately two months past the end of the comment period for the proposed amendment to the rule. This comment period was adopted to allow enough time for reviewers to focus on developing comments, first on the proposed amendment and then on the draft implementation guides and submitting them before their respective comment periods end. In accordance with current guidelines of the directive system, the document numbers for the implementation guides have been changed.
