This is a Notice of Violation (" Notice") issued pursuant to Section 1.89 of the Commission’s Rules, 1 to Comcast Cable of New Jersey LLC. (“ Comcast Cable”) for violation of Section 76.614 of the Rules, 47 C. F. R. § 76. 614. 2. On July 17, 2003 and October 08, 2003, an agent with the Enforcement Bureau’s Philadelphia Office conducted signal leakage measurements of the Comcast cable system in Long Beach Island, New Jersey. During the inspection, the Philadelphia Office found that Comcast Cable was in violation of the following: 47 C. F. R. § 76.605 (a)( 12): ``... signal leakage from a cable television system shall be measured in accordance with the procedures outlined in § 76.609( h) and shall be limited as follows:” on frequencies over 54 up to and including 216 MHz the signal leakage limit is 20 micro- volts/ meter at a distance of 3 meters. On the frequencies of 133.28 MHz and 115.25 MHz, at a distance of 3 meters from the cable system components and 3 meters above ground, the following cable system leaks were detected in Long Beach Island, New Jersey: . Pursuant to Section 308( b) of the Communications Act of 1934, as amended, 2 and Section 1.89 of the Commission's Rules, Comcast Cable must submit a written statement concerning this matter within 20 days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific actions taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective actions. The response must be complete in itself and signed by a principal or officer of the licensee with personal knowledge of the matter.
